I can only imagine what that poor gentleman is going through with all the cabins that he has. He's got an Airbnb that he runs down there. And what a better spot. And right next to him is some guy that's decided to park a bunch of empty RVs. Gee, I wonder what could happen with those.

Nothing bad. Not to mention the fact that just down the corner from me is a meth lab. And everybody knows it's a meth lab. And the sheriffs won't do anything about it. I don't understand.

But at any rate, that's what we're living in today, folks. So we'll talk with Claire on national security stuff coming up. I'm going to talk to you about truth, veritas, and why it's so important that we build our foundation on truth.

And speaking of truth, another slayer of lies and thrower of the spear of truth, a friend and constitutional originalist, Mr. David Shostakis. David, welcome. Good to have you. Thank you so much, Greg. It's great to be with you. It sounds like there's going to be a great program.

So while I'm at the gym, I can plug it in, get it out of my phone, and plug it in my ears and then listen to you on the treadmill, which is the best use of that time. There you go, brother. There you go. All right, so I sent you a little blip about the Disrespect for Marriage Act, you know, where I thought we might start that might be a good place to begin.

And I know we kind of laugh about this, but it's really very serious. It's kind of what has spawned the push for them to get this through and get it signed. And that was Clarence Thomas' writing and the decision... Concurring opinion, yeah. Yeah, the decision of the Supreme Court by a five to four margin.

And essentially what they did was they unwound, or at least brought into question, the issue of substantive due process. So it sounds to me like that's probably the best place to begin our conversation today. Certainly. We can begin our conversation about this, as you call it, the Disrespect for Marriage Act. You know, language is obviously very, very important, and when they call it the Respect for Marriage Act, that has the effect of repealing what was previously known as the Defense of Marriage Act, you can see the language, Legeremain, that is taking place.

Sure. You know, it's so Orwellian when you title something that's exactly opposite of what it actually is. So it's very, very important. But essentially they say that it codifies under federal law both same-sex marriage and interracial marriage, which is really very strange. It's so often, you know, it's very problematic when the government decides to pass a law to essentially virtue signal because they pass this law that was looking for a solution for a problem that doesn't exist because, of course, you know, they threw in to broaden the support, they threw in interracial marriage, which, of course, has been a big deal in the United States since 1967, since the miscegenation laws were found to be unconstitutional in Loving v. Virginia in 1967. So that certainly was a problem or a solution for which no problem exists. And, of course, the other situation where they're talking about same-sex marriage, again, that was addressed in Obergefell in terms of that situation. And originally in a case called Windsor, and the Windsor case set the stage for Obergefell. Again, essentially, again, this was a solution without a problem so that they could make up signals that they were doing something about something.

So this is problematic because, again, there's no problems. Well, even with Obergefell, which the reason I bring that up is having to do with the issue of a substantive due process and they address that because of the Clarence Thomas decision. But at the end of the day, they have violated the rights of we the people in individual states and they have breached the power of the state.

You have 32 still, I believe 32, maybe it's 31 now, I know there was one that repealed, but 30 to 31 states who still have on the books constitutionally by majority vote of the people living in that state a constitutional amendment that says that marriage in our state is going to be identified as between a man and a woman. Yes, and this is, of course, where Obergefell failed and actually runs contrary to Dobbs. The Dobbs opinion is the one that, of course, overturned Roe versus Wade and said that basically it said those kinds of matters, family matters, personal medical decisions, those kinds of matters belong to the states. They are not federal government business. And pursuant to the Tenth Amendment, that is among the powers that is reserved to the states because it was never given to the federal government anywhere in the United States Constitution. So there's a fairly high probability that the act that everybody is celebrating now runs afoul of the United States Constitution.

And so this becomes problematic. And it is in response, as you said, to a couple of paragraphs written by Justice Thomas. Justice Thomas indicated that the whole concept of what they call substantive due process, which made my eyes glaze over in 1985, my first year in law school, and still makes my eyes glaze over some 37 years later. And I don't know that anybody knows what substantive due process means. It just means that when the court decides that it wants to do something, they can take authority to do it.

And Thomas essentially said within the Dobbs opinion that they did not have, what Dobbs was doing was recognizing the limits on the court's authority and that substantive due process is a concept whose time has come and gone. And so that would mean that they would just read the Constitution, and if they just read the Constitution, these kinds of questions do, in fact, belong to the states. And so, yeah, the government does this on a regular basis, and when they do, they supposedly do it to recognize and protect certain groups of people, but whenever they do, they wind up tromping on the rights of somebody else.

And this is what the problem turns out to be. I would analogize to what they did to what happens when they create hate crimes. Right. A hate crime is a waste of legislative activity, because if you kill somebody, they're just as dead no matter what the purpose was for why you killed them, whether you killed them to rob them, whether you killed them because they had different beliefs or you didn't like them, or you killed them because they interfered with your family somehow.

And welcome back to Chosen Generation Radio, where no topic is off limits and everything filtered through biblical glasses. All right, so we're talking about, you know, this, what I've termed a disrespect for marriage act. I think you agree with it in the sense that it has rolled back the defense of marriage act, not rolled it back, wiped it out, eliminated it.

Marked it out. It has eliminated the Religious Freedom Restoration Act. They've made some claims that they have put in some kinds of protections. But let me read, if I may, the statement. This is from the National Religious Broadcasters Association, a nonpartisan international association of Christian communicators, a statement by Troy Miller, the president and CEO. The Respect for Marriage Act is a reaction to a fabricated problem that does not exist.

You mentioned that, David. The ability to obtain a same-sex marriage is not in jeopardy in America today, and this bill does nothing to change the legal status of same-sex marriage anywhere. However, the ability to do business or speak in the public square while holding to traditional values about life, marriage and family is very much under threat. These are part and parcel of the First Amendment freedoms that NRB exists to defend. The Respect for Marriage Act puts faith-driven Americans in legal jeopardy by practicing their beliefs and instead greenlights the interests of radical activists seeking to penalize and bring harm to those who dissent from their views. This exposes Christian social service groups and other entities to predatory litigation with a broad private right of action clause and jeopardizes the ability of religious nonprofits to obtain charitable tax-exempt status from the IRS. Tragically, some faith-based organizations signed on to this bill based on the illusion that their rights and freedoms will be protected.

Over time, it will become clear that they were mistaken. We will continue to fight for First Amendment freedoms despite this significant setback today. Well, that's a very, very accurate statement of what's happened in terms of endangering the First Amendment rights of other people, including the freedom of association, freedom of expression. I would suggest that we still will have the standard concepts of no compelled speech. I don't think this has any effect on, say, cake makers and wedding planners and people that offer services associated with weddings that choose not to offer those services to people who are going to have a same-sex marriage. I really do not think that impacts this because, again, this is statutory. And the theories behind the protections for people that do not wish to engage in activities that support same-sex marriage falls under a First Amendment concept of compelled speech.

It's not actually within a religious category. And so I suspect I would like to think that those kinds of cases, circumstances should not be in danger as a result of this. The situation where it ultimately did, in fact, explicitly repeal the Defense of Marriage Act, again, as your writer indicated, it's a solution without a problem because DOMA was effectively declared unconstitutional between Windsor and Obergefell. There was no life left in DOMA in any event.

And so it was a solution without a problem. I did reread this morning in preparation for this the Religious Freedom Restoration Act. And I also reread it in light of reviewing this Disrespect for Marriage Act. And it would appear that the Religious Freedom Restoration Act, at least on its face, is not technically touched by this matter.

And so I have high hopes. But you see, now it does, in fact, depend upon court interpretations of things that are potentially in conflict with one another. It was a conflict that didn't need to be made. And so I don't know. It's a political statement with the government getting into someplace it doesn't.

And I would just leave the rest of this at this. And this was Justice Thomas Thomas' idea about the substantive due process. And that is this business of marriage and family and the relationships between family. And this does not change the fact that the federal government was never given authority over that by the United States Constitution and that the Tenth Amendment reserves the authority of that to the states. And this doesn't change that in any way, shape, or form whatsoever. And all it's going to do is make more litigation. And it's just so irresponsible of legislatures or those folks like that to pass things and to make people feel good, like Cyndi Lauper, to make Cyndi Lauper feel good and then endanger other folks and then burden the court systems with sorting out problems that never really existed. It's incredibly irresponsible and divides the American people further. It's a divisive act, not an act to bring people together. My greatest concern, David, in all of this is what does this do to our education system?

Because what people forget is that these kinds of policies find their way. They're directly impactful in the education. They're directly impactful in sex education to the children. They're directly impactful in educating a child. You tell stories and you begin with books that talk about family. And now you're redefining what that's going to look like, which means the children are going to have to be explained to. Questions are going to have to be answered.

So, you know, I was mentioning as we were going into the break that the problem then that you have is then it enters the education system.

And I know you mentioned, you know, the Department of Education is an unconstitutional entity. And then the role of feminism, right? Because the role of feminism was to take women out of the home. So now you don't have someone at home that is watching out for the children and raising the kids. And so you – and you mentioned, you know, you cut the wages down so you pay the woman less than you pay the man so you get cheaper labor.

And now you need both husband and wife. And I've gone through the progression, David, of explaining too that, okay, so now what happens is – and this is another part of this. Parents from the 50s were raised by their parents who wanted to give their kids a better life.

So that was the thing. Okay, so now you have another generation that says, well, we want to give our kids an even better life. Well, as this situation arises, you find – you meet an eclipse where those children become the adults.

And they're like, well, you know, I don't want to give up my toys. I don't want to give up my better life just because I have kids. And so how do I keep my better life and still have kids?

Well, the only way for me to do that is I got to go out and work and so somebody needs to nanny my kids. And the nanny became the state. The state became the nanny for the children, okay, so that these children whose parents with good intent initially were trying to give their kids a better life but ultimately didn't give their kids a better life. Instead, they gave their kids greed. And they gave their kids a different life, but it is the culmination of a series of governmental programs.

And I would suggest – And projects to undermine the family as an institution. Well, but I would suggest that that goes back to an undermining or an eliminating of God because who is it who actually designated what a family looks like and is the foundation upon which the family rests. It's the Bible, it's biblical, it's scripture, it's God. Just like our rights. And the rights, you know, my argument is that our rights aren't something God gave us. They're something God literally put in us. They are literally – when He made us in His image, He made us with life. He made us with freedom, right, free choice. He made us with the desire to enjoy life and to live it to its fullest. But He also gave us a moral guideline, a moral compass. Now that compass got knocked off track because of sin in the Garden of Eden. But then what did He do? He sent His Son Jesus Christ. Not just to wash away the sin so we could do it again, but literally to take out of us that seed of rebellion, put it on the cross and exchange it – think of it as a computer – with a new chip.

And that new chip says, hey, you know what? I know what's right. I'm going to go back to doing the right thing. And so when our founders came to America having been able to now read the Word, know the Word, consume the Word, understand the Word, study the Word for themselves, not through the translation of some hierarchy, they were like, wait a minute, this is what I want to live by.

This is good stuff. This tells me who I really am. And so they said, now I'm going to create a government that's going to protect my ability, my rights that God's given me. Yes, and of course this is always interesting because of course you look at that through biblical glasses, as Sue famously said, and with the pastoral view. I will tell you that your pastoral view is in fact expressed in our organic law, in terms of the actual legitimate legal authority of the United States of America is in fact derived from the concepts that you just went through and expressed in the legal document that created the very existence of the United States, in which case the United States assumed its place among the powers of the earth according to the laws of nature and of nature's God. And that was the concept that actually founded the country.

And it has legal implications. Unfortunately, the Supreme Court over the years has pooh-poohed the Declaration as not having legal implications, but the first Congress actually adopted the Declaration of Independence as part of the organic laws of the United States of America, and it deserves a place in the interpretation of our laws. One of the reasons that over the last couple of hundred years the Supreme Court has ignored the Declaration is in fact it handcuffs them, and there's so many aspects of the Constitution that it handcuffs government.

Let me throw this in while it just popped into my head, if you don't mind. The thing about that is that the Declaration of Independence is the foundation that upholds the Constitution. The Constitution is what makes America unique because it is essentially saying that it's we the people that are the sovereigns.

When you go back and you look at Romans 13, who installs? God installs leaders. God installed us, we the people, in the United States of America as the sovereigns. Not your congressman, not your senator, not the president, not the Supreme Court justices, not your governor, your state rep, your state senator, your city council member, none of them.

None of them. You're the sovereign. You the people are the sovereigns in this. In order for them to flip that, they have to nullify the Declaration of Independence. That's right. That's why they had to get that out of there. That's why they have to push that out and say, no, that's not part of it.

That doesn't apply. Well, the reason why is because the Declaration of Independence sets in place what then becomes the basis for the sovereignty of the people of the United States to be the sovereigns of this nation. We've been given great rights. The problem, of course, is everybody jumps up and down and screams about their rights as they seem to forget that with great rights comes great responsibility.

You have to exercise them. The government is intended to protect those rights, but the government reports to you. So in terms of the government protecting those rights, you have to make sure that the government does that. Often I've done plenty of different criminal defense work in my day, and several people say, well, how can you defend somebody if you know they're guilty and whatnot? I say, frankly, it doesn't matter.

None of that matters. What matters is if the government is going to seek to take somebody's life, liberty, or property, the government has to follow the law. And our job, when you're doing defense work like that, your job, in fact, isn't necessarily to prove somebody innocent or not guilty. Your job, in fact, is to make sure that the government follows the law, because if the government follows the law, then your client is going to get a fair shake. And that's the ultimate outcome. We all have to make sure that the government follows the law. It's our collective responsibility to do that.

Let me see. Regarding the destruction of the family that we were talking about earlier, it's just been a series of government policies that have worked. What comes to mind is some of the provisions they have for folks who get assistance or welfare, that they can only do so if there's no father in the home. Here's one to what you were just saying. This is what I wanted to look up, but this is 1 Timothy 1.8. Again, you're talking about, you know, these things come, and really, folks, they're biblical in their nature. This is why we have the biblical reveal. We know that the law is good if one uses it lawfully, knowing this, that the law is not made for a righteous person, but for the lawless and insubordinate, for ungodly and for sinners, for the unholy, profane murderers of fathers and mothers, and it goes on. So the purpose of the law is to stop those individuals that are breaking the law. But if those that are the administers of the law are breaking the law and administering the law, then the righteous will suffer. Not the unrighteous, but the righteous.

Final seconds before we go to break. Go ahead. Recently, President Trump had some commentary about the issues with the Constitution, had had the 2020 election been fraudulently conducted. And so, I don't know that he was a little bit inarticulate, but the fact is if the people that have been installed were installed illegally, then the Constitution is already not in effect. And I think he could have been more articulate about that. Right, right. Yeah, well, that was where they were saying that he was trying to abolish the Constitution.

If you read the whole thing, that wasn't really what he was saying, but I agree, he wasn't as articulate as he should have been. We'll be back after this break. Man, I'm telling you, you and I could go on for hours, there's just so much to cover. I thought we might possibly want to just take a quick spin through the SCOTUS blog to just kind of see some of some of the things that are coming up, because... Well you're going to be gone for a couple of weeks, but when we come back, this Brunson matter will have been to the Supreme Court Conference, and we will know whether they are going to actually grant Sersari to the Brunson brothers, four trumpet players out of, I believe it's either Utah or Idaho, Utah, who are challenging the legitimacy of the 2020 election. And the fact that then, their argument is that 335 members of Congress, and Vice President Pence, Vice President Harrison, President Biden, all violated their oaths of office by failing to investigate the allegations of fraud in the outcome of the 2020 election. And more importantly, that they failed to fulfill their oaths because the DNI, who was the Director of National Intelligence, wrote a report suggesting foreign interference.

That's the issue. The big issue is, is that there was evidence to suggest that a foreign nation violated our 15th Amendment right that everyone's vote would count, that everyone would have an adequate opportunity to vote by interfering with the election. And that means that they violated our Constitution, that's an invasion. And so all he said was, is I need more time to investigate, to follow this trail of evidence and see where it leads. And I'm suggesting, give me 10 days, which still falls within all of your timelines and guidelines, but give me the 10 days and give me the finances so I can put the personnel into place so we can do the investigation. And these 335 individuals blocked that investigation, subsequently becoming co-conspirators with a foreign nation.

That is the essence of the argument. And it's very, very encouraging that up to now, if somebody hasn't looked up Lloyd Brunson and Google him, and I believe he was with... He was on my show.

He was on my show. Look up the podcast that you had with Mr. Brunson and explore this issue because it's certainly not getting any coverage, but the court has agreed and actually helped them kind of fast track getting it to the court. He's also Brunson's family. The court actually, through their courts and otherwise, assisted the Brunson's in getting this fast track to the court. They've strangely enough agreed to have an conference on the 6th of January. Interesting days. Yeah, that'll be the two year anniversary of that infamous date when I was in Georgia and they were taking the United States Senate while everybody was watching Washington DC. That's a whole separate story. But in any event, this is something to closely watch. And when we come back from Christmas break, if you will, the court will have been undertaking to investigate this case. That's a really, really exciting thing that nobody in the legit, or not legit, but mainstream media is paying any attention whatsoever.

It's amazing and it has the ability to powerfully alter what's going forward. And the thing that Loy said in my interview that I thought was so important is he said, look, this isn't about proving that we're not trying to prove that the election was rigged or whatever. Our lawsuit's focus is not on that. Our lawsuit's focus is on oath. Do the members of Congress have a constitutional responsibility to follow article six? Because essentially they gave themselves by statute and out. They by statute said that that oath doesn't apply to them. So they sit there when they go into office and they all swear the oath to defend the constitution against all enemies, foreign and domestic, knowing that there's a statute on the books that basically says the oath you just took, you really don't have to follow that oath. So the lawsuit is saying to the Supreme Court, essentially, hey, you need to look behind and Michelle will laugh at this, but you need to look behind door number three, which is where they stuck all those ballots, but you need to look behind door number three and see what's really there. Because what they put behind door number three is an unconstitutional statute that basically nullifies the oath that they take every two years and every six years and every four years to suggest that they have to follow the constitution.

And is the Supreme Court going to do something about the fact that they're not following their oath? Yes. Well, the Supreme Court enforce article six. Yeah.

It comes down to that simple question, will enforce article six. Yeah, exactly. It's a fascinating case.

And that's a biggie. It's wonderful. And it's very encouraging. I would let people know that none of the Brunson folks, there's no lawyers involved.

There's no lawyers involved, which shows you that citizens, that if they will take the time, they can achieve great things in the courts without an attorney. Amen. All right.
