So except when it comes to, you know, ending the lives of murderers and rapists and actual hardcore criminals that deserve the death penalty. We're not we're not down with that.

But killing innocent babies, we're down with that and killing Christians and burning them at the stake. We're almost we're almost down with that. We're getting there. All right. Well, welcome aboard.

But when Joe Biden tells his followers to go out and start killing half of America, and they actually do start killing people. Hey, you know, not a problem. We're in a sick upside down world. My goodness. Let's see.

There there may be some use. What is that? C. C. S. F. I think it is or something like that. Anyway, there's some there's some Texas Raiders going on.

Texas Tech Raiders are are, I think, has some red and black in their theme. But anyway, David just took us. Our constitutional originalist is with us. David, welcome. Good to have you. Fine. Thank you, Greg.

It's great to be here. There are there is actually no message in the colors whatsoever. Oh, come on.

I was running a conspiracy here was a conspiracy. The message is that it's almost October and here in Illinois it was in the 40s overnight and I needed a little sweater this morning to take the chill out. So it's there's actually there's literally nothing in the colors.

I'm sorry. So apparently there's a little perhaps Halloween peeking out. You know, maybe there might just be a little Halloween on its on its thing. And so we'll see. But, you know, it's just interesting. You touched briefly on the Russian Ukraine situation. Yeah. Air superiority. And of course, we now have this situation where Russia is trying to institute a draft to get their get the folks they need to continue this military operation, special military operation that they have going on. Yeah. The only thing that the only thing that personally occurred to me is about, oh, about one hundred and ten years ago, during the course of time when they were invading some of their neighbors in other situations.

This is not new. And they invaded Lithuania and they attempted to draft both my grandfathers who were Lithuanian, both of whom, in order to avoid being conscripted into the Russian army while in fact they were Lithuanians, left Lithuania, came to the United States. And in fact, in some respects, it was a Russian draft from one hundred and ten years ago that allows us to be sitting here talking. Wow. Because both my grandfathers left Lithuania because the Russians were trying to conscript them into a Russian army.

My, my, my. Well, Russia has been invading its neighbors over and over and over again for many, many, many, many, many years. The czars did it. And then, of course, the communists and, you know, they were wiping people out. And Patton said at the end of World War Two, let's just go in there and wipe those commies out.

They're going to be a problem for us. Yes. And I, I, I, I think that that may well have led to, you know, the murder of General Patton. And I do believe it was a murder. I think there's a lot of evidence that could support that. I agree with you regarding General Patton's assassination.

You know, I agree with you in that regard. But it's just, I think it's interesting. The story about my grandfathers is how important it is for people to know history. You know, it's, it's how important it is for people to know history and to take, you think, and to put what's going on in our world today in perspective and be able to understand it and, and take those things into account in terms of making decisions going forward.

Right. So my, I think my brother and really, literally both my grandfathers were going to be conscripted in the Russian army 100 years ago, as well while they were invading Lithuania. Yeah, I just got some, some, you know, messages about people that are that are leaving in the same way. I mean, the Russian, what people need to understand that I think is not, you know, in the, in, in the news, if you will, is that, you know, the Russian, a lot of Russian people are not in support of Putin and this invasion and this war.

And, and there are a number of individuals that are fleeing, especially now that they're in trying to institute this draft that are fleeing the country in an effort to, you know, not not have to go in and, and shed blood and what in what many in that country perceive as, as Putin's efforts to, to become, you know, an authoritarian in that part of the world. And so at any rate, yeah, lots going on with that. So it's just, yeah, I mean, it's just a background thought that yeah, it's not new. And studying actual history, rather than trying to erase history, you know, even regarding history, even if it's history you don't like, we need to be reminded of it so that we can learn from it. Turning down statues and turning, turning down, getting rid of books that tell actual history and things like that. That's so dangerous, because of course, that's in a situation where we wind up repeating history because we don't know history. Well, and, and, and, and we're gonna have to take our first break. But also, as it relates to the Constitution, one of the reasons that we do what we do here on our Wednesday program is, is to try to help people understand the Constitution. And one of the questions that I want us to cover, we're going to talk about elections, we're going to talk about several different things. But one of them has to do with the clause number three, Article One, Section 10, clause three, acts requiring consent of Congress.

And what are the rights of a state if they are in fact being invaded, and that invasion and danger to that state is imminent. And we're watching that back after this. It's 600 square miles, which is a pretty large chunk of land. And that particular area does have some of its own law enforcement. And nonetheless, there was a question as to whether or not the county sheriff was contacted and asked. And the FBI apparently, one of their mouthpieces said, oh, yeah, we did.

Well, I called and I asked, and I was told, absolutely not. The FBI made no efforts whatsoever. As a matter of fact, they were made aware of the situation when it broke in the news. And the details that they got were from some callers that called in to them saying, hey, this, this, this, and this.

And that was when they went out and got the details and found the details. So the FBI did not follow any form of common courtesy. You're a former prosecutor, by the way. So let me let you speak to the idea of a federal agency coming into a jurisdiction where you're a prosecutor and making no effort whatsoever to contact your officer or any of your folks. I'll tell you what, there's a couple of problems with that, not the least of which is, though, it's very, very dangerous because the local folks, if they're not informed ahead of time, may very well not know who these people with guns are. And it's very, very dangerous when you have people with guns and another group of people with guns, both of whom are law enforcement of a sort, who are unaware of the activities of the other. And that can turn into an extraordinarily dangerous situation. So first of all, one of the circumstances has got to do with potential danger to law enforcement themselves because they don't know who the good guys and the bad guys are.

They haven't been informed in the first instance. In the second instance, of course, we still wind up in a situation where we have the Tenth Amendment and states and their local authorities are, in fact, responsible to have police powers. And to the extent that those powers are to be enforced, the FBI and the other federal agencies owe a duty to the local folks to give them a heads up on what they're doing. And allow the local folks to have the opportunity to weigh in on the legality of what it is that they're doing.

So it's a huge problem when they do not inform the local folks. To that end, I'm glad that you bring that in because I wanted to go there, and again, we're going to run up against a break, but then we'll talk more about this coming out of the break. You, you know, really gave us a great education here on the program regarding the Ninth and Tenth Amendment. The Ninth Amendment saying that the enumeration in the constitution of certain rights shall not be construed to deny or disparage others retained by the people. And it's important for folks to understand the Ninth Amendment is securing and it's before the Tenth Amendment and it secures all of the rights to the people. Secondly, the Tenth Amendment, which says the powers not delegated, which you quoted, to the United States by the Constitution nor prohibited by it to the states are reserved to the states respectively or to the people. And you have given us a very clear definition of understanding the difference between the rights and the powers. Powers belonging to states or government entities, but powers given by the people and never to infringe upon the rights of the individual, but to protect and defend and support the rights of the individual. We'll talk about that coming up relative to this situation and going back to what I addressed with the clause three about invasion and who's doing invading.

And welcome back to Chosen Generation Radio where no topic is off limits and everything filtered through biblical glasses. My very special guest today with Shostakos. Shostakos.com, our constitutional originalist attorney.

We were talking in the break. Let me throw that to you regarding that article, the invasion issue, the rights of the people versus the federal government and the powers of the states. And just one last piece to add to that.

And this is something I shared too in a speech that I just recently gave or sharing that I did a couple of Saturdays ago at an event up in Kerrville. Unlawful government mandated shutdowns of our places of worship and businesses, forced injections on citizens for travel and work, treatments that killed our loved ones and friends, a clearly stolen election, an invasion at our southern border and a humanitarian crisis, the perverting of an entire generation of children where as many as 39% of Gen Z are claiming LGBTQ, forced gender mutilation, lawlessness and murder in our cities. That's the list right now, brother.

And that's just a partial list, but that's pretty significant. And it's guidance on these matters. There are 28 grievances laid out against King George. And before they lay out the grievances, it's discussed the fact that the purpose of government is to secure the rights to life, liberty and the pursuit of happiness. And then following that is that whenever a government fails to do that, it becomes the right of the people to alter or abolish it. So the Declaration of Independence gives a definition of when a government has lost its legitimacy and is in a situation where the people have the right to alter or abolish it.

There's a lot of things that you just mentioned that are the equivalent of the things that King George was engaged in in the 1770s that led to the revolution and independence. And so it's really worthwhile for everybody to read, understand what the Declaration of Independence is. And I also would mention that frequently the Supreme Court, because it's inconvenient for them, when it comes up, they say the Declaration of Independence is not law. The Declaration of Independence, in fact, had legal consequences by separating us from Great Britain. And beyond all that, the first Congress in 1789 adopted the Declaration of Independences among the organic laws of the United States of America.

And so it is, in fact, law. It's worth reading. We don't teach it just because they don't want us to know things like the right to revolution. And the government school is not going to teach a revolutionary document. We have to go out and learn it ourselves. And so it's just so important for people to go and learn that. Shostakos.com. Okay, let's get into, where do we want to go next? I guess let's get into the preview, the SCOTUS preview. There's a lot of big stuff going on there. I think there's a couple of books entitled The First Monday in October because it's always such an important time when the Supreme Court starts to hear new cases. There's a few important things coming up. The court has decided to take two cases on college admissions and affirmative action, which is just really, really important because since 1978, in a case University of California Regents versus Bakke, they've held that affirmative actions in college admissions, where you can make conscious race-based decisions on who you're going to let into your school, even if you're taking federal money, has been considered legal since at least 1978. The fact that the court is now taking these two cases, one from Harvard, which interestingly enough, the new justice, Katonji Brown, has recused herself because she was once on the Harvard Board of Overseers and has determined that it's not going to be right for her to make a judgment on a policy that she was part and parcel of determining.

Interesting. And God bless her for doing that because Supreme Court justices actually are on their own on that. Nobody can tell them to recuse themselves or not.

So bless her for making that decision. Kudos to Justice Katonji Brown on that situation. The North Carolina also, there's another affirmative action case involving North Carolina. And the congressional districts, right? That one has to do with congressional districts?

Yes, I'm sorry. It has to do with congressional districts and the equivalent of race-based gerrymandering. It has to do with the ability of the states to maintain control of elections versus turning that responsibility over to the federal government.

Yes. In the end, that's exactly right. But the fact is, apparently people are complaining that the state did not draw enough majority-minority districts within their districting plan. And so both these cases can be extraordinarily important in terms of the possibility of getting back to the idea that the Constitution and the laws should be colorblind. That is, we should be a meritocracy, not a race-based, race-conscious society. And so the Harvard case could be huge because that would remake, reshape university education in terms of making it so that we have the best and the brightest, not necessarily people that fill the bill based on immutable characteristics as opposed to their achievement. And that's something that a lot of our Asian conservative friends are very concerned about because they have, in particular, suffered in their inability to be able to get into some of these higher institutions because of specific quotas and so forth.

So there's a lot of conversation that leads back to, again, like you said, whether or not it's meritocracy. There's another case too. The court has denied Yeshiva University's request to block a ruling on LGBTQ recognition of a club. Now, initially, there was a hold put on it. And now the next step, the Supreme Court, with Kavanaugh and Roberts joining with the liberals in a 5-4 decision has said, you've got to go back to the state courts. We don't feel that this case is ready to come to our level yet. It still needs to have some more adjudication at a lower level. Does that signal anything in particular to you relative to religious freedom or religious rights, or is this all procedural?

It's primarily procedural. You know, one of the first things that they tell you in the first year, first semester of law school is you have to know procedure, that you can be as right as rain on the law, but if you file a case beyond the statute of limitations, you're going to lose even though you're properly correct on the law. Or if you miss procedural deadlines, or you don't do what they call exhaust your administrative remedies, there's a variety of procedural rules.

And if you do not file a procedure, regardless of how right you may be on the law, you will likely find the courthouse doors closed to you. And so they've sent it back, but they did an unusual thing in that matter. They actually did publish the vote being 5-4. They actually did, in fact, have a short statement that was issued along with the sending it back to the lower courts, indicating, of course, that there were four justices that were ready at this particular juncture to uphold Yeshiva's right to regulate the club organizations on its campus. Okay, but so when there's when there's four justices in favor of that it takes four justices to grant certiary, which means that yeah, the court will you will hear this case. Okay, so in other words, take it back, do what needs to be done.

Make sure that you have exhausted everything at the state level. And then we will in fact, allow you to bring this case back to us at at at at the federal level at the Supreme Court level. Yeah, if if you need to, okay, then that message was not only for the litigants, that message was for the lower courts, and basically told the lower courts Listen, if this if this comes back to us, you can pretty well expect what we're going to do.

So it may not it may not ever get back to them. Interesting. Okay. Very interesting. All right.

We're going to take a break. We've got more on the other side. We've got there's there's a lot more going on with regards to because there's some specific election cases. I guess the North Carolina case is somewhat that but there's some specific election cases that I that I that I saw. Yeah, yeah, indications of so we want to talk about that. There there's there's a Maryland prison assault case that that has to do with procedure type stuff that you were just talking about and significance of that. So there's a lot coming up in this next session. It's going to be a big one, religious freedom and religious liberty as well.

And once again, you know, Colorado is coming back at this and saying, you know, here we go. Yes, Colorado keeps coming back because it's not just the Masterpiece Cake folks that are back before the Supremes, but there's also another Colorado case involving a website designer who will design websites for folks for their weddings. But in fact, publishes on her website that she will not design websites for gay couples that are choosing to get married for gay marriages. And strangely enough, the statute involved there prohibits this website designer from telling the public that she will not do that.

She will not provide that service. But they want to prohibit her from saying this on her website, which again, of course, is the flip side of Masterpiece Cake where they're saying it, where they want to say, well, you have to, you have to, it's compelled speech. This is now prior restraint.

It's the flip side. It's where Colorado is saying to the woman that's the website designer, you cannot tell people that you won't design things for gay folks. On the other side, they're telling the Cake folks, you must, you must convey messages that are contrary to your personal morality. They're doing both possible violations of the First Amendment that you could have.

Compelled speech and prohibited speech. That's crazy. These people are insane and they keep coming back.

Right, right. They won't, they won't, they, you know, unlike, I mean, out in Oregon, you know, they lost. Now, I have to say that Aaron and Melissa, you know, the climate was so hostile for them that they actually moved out of state. They, they, they left their home. They sold their home and they left their home. They took their, their settlement and they, but they, they moved, they left. Jack Phillips has said, hey, I'm not, I'm not leaving Colorado.

I'm not, I'm not going to run away from the, you know, and, and, and let me be sure, Aaron's a friend of mine. They didn't run away. They just said, look, we, we, you know, their, their situation, they got small kids. You know, they're, I mean, for them, it's like, you know, what do you, you know, you, you can't raise your children in an environment where your kids are, are in danger potentially.

Yeah. There's, there's some benefits to have in 50 states and among them is that your, your ability to vote with your feet. And there's plenty of folks in plenty of blue states that in fact are just doing that. They're voting with their feet.

This is why places like California or Florida and Texas are growing and California and Illinois are losing population. So it's not unusual for people to vote with their feet and Colorado has been a traditionally conservative place. And so I think too, that, you know, you've got, you've got a bit of a battle going on still in Colorado over, over what it's going to be. You know, just like there was in California, right?

I mean, we fought, I fought and fought and fought and fought in California until we finally came out of there and we, we, we just, you know, we didn't feel like we could win that fight at that point, especially with the court system being what it was. You know, one, one cautionary tale regarding both Colorado and Oregon, they're dominated by mail-in voting. I just, we can talk to issues all day long until we get control of the electoral process and wind up, oh, I don't know, like they do in Italy, one day, one vote, paper ballots. And look what, and, and, and congratulations, by the way, to, uh, Giorgia Milano, I believe was her name, but, uh, you know, the, the new conservative prime minister in Italy, the people of Italy have spoken and, and, you know, the Italian people, and I have Italian heritage, but the Italian people traditionally have very strong traditional biblical values. I mean, that's very much in the DNA of, uh, of the, of the Italian people.

So, uh, so good on them for, uh, for their support. And of course, that shows you what happens with an election that has integrity. Uh, that, uh, and that showed in places like Oregon and Colorado show you what happens when you're dominated by mail-in voting and nobody really, really knows what's happening when those ballots show up, um, from the post office. So to that point, um, the Supreme Court has, we're going to, I don't want to run out of this time on the election side of this, the Supreme Court does have some election cases.

Can you speak to those for a moment? Yeah, there's, uh, there's a, there's a, there's a particular case regarding voting rights and the situation about whether or not state Supreme Courts have, or state court systems have, uh, have authority to modify the processes of federal elections. And, um, that will be very, very interesting because that's been at the heart of some of the challenges to 2020 because in fact, that was at the heart of what was going on in Pennsylvania when I was working there. The, uh, Pennsylvania Supreme Court was regularly changing regulations willy-nilly all by its, all by its lonesome. When, of course, article two, uh, section two, I believe the electors clause says that these, uh, this authority rests with the legislature. Not with the judicial tyranny, like we experienced in California, as an example. That particular issue is at the heart of some of the major challenges or the major philosophical problems that happened in 2020 is that there was both executive and, uh, judicial branches usurping the authority of the legislative branch that is given to them, not by their state constitutions, but by the United States.

United States Constitution. And so, uh, that's, that could be a blockbuster of a case. Uh, and we'll be looking forward to talking more about that because that's just really important and goes to the heart of 2020. Okay. Um, uh, just in our, in our final moments, um, I know that, uh, you've got some things going on there specifically in Illinois. Is there any, uh, updates or anything you want to share with regards to that particular situation? We're, uh, we're working hard with the folks in central Illinois to see to it that they get their proper representation in a town called normal of all places. Uh, you know, things are not normal and normal.

I would tell you that. Okay. We've, um, we've not been successful at two, uh, two levels and now where I'm contemplating, we're talking with my, uh, my clients about, uh, the decisions, uh, to, uh, to appeal, uh, their ability to break their, uh, break their talent into districts so that they can, because I think we've talked about this briefly, but this is a 17th amendment kind of problem that when somebody represents 12 million people, say for an entire state, a United States Senator who they represent, they represent nobody. They represent the people that give them the money to tell other folks to vote for them, you know, and the more we can make more districts, smaller districts so that the representatives are closer to the people and more responsive, the better off we will be. And, uh, then there are smaller elections as well, in which case they're easier to count. Yeah. Well, and, and that, and that speaks to a representative Republic, right? If we're going to be a representative Republic, then we need to have individuals that are representing us, uh, you know, in, in, in accordance with that. Uh, okay.

Uh, David Shostakovich, shostakovich.com, our constitutional originalist. And, um, I'm, you know, there, there's, there's just, there's so many issues and topics, I guess. Well, final, final 50 seconds, if a state is being invaded at its border, because we really didn't get, we, I forgot to bring us into that particular piece. I guess we'll have to do that in our, in our next visit next week. But, you know, there, there is something to be said about the right of a state.

You mentioned about, you know, the teaching of the declaration of independence and so on. I think there's a lot to explore with regards to that. Would you agree? Oh, absolutely. The, you know, the very first duty of the federal government is in fact to secure our border.

That's, uh, that's it. That's, that's, that's the prime reason they exist. That's why we pay taxes. That's, uh, that's why we have the Constitution. Yeah.

And not to, by the way, invade the borders of the state. We're going to run out of time. David, thank you so much for being here. I appreciate it. Folks, you're going to take a break.
