Wow, I'll tell you what. So Windows did an update yesterday and everything was working fine. I come in this morning, I turn the computer on and nothing wants to work. Isn't that typical?

So typical. Alright, I got a great program lined up for you. I want to get right to it. Ward Connerly will be with us.

The race wars continue. We'll talk with him about that. Mark Morgan, the former CBP chief is with us for a full hour today to break down what's happening at the border and his view of all of that. And Scott Uehlinger, the station chief is with us. We'll get his take on some of the new revelations about CIA activity and some things that are happening in the intelligence community.

We'll get his take on that as well as his take on Ukraine. And Cece O'Leary from SLF, Southern Law Center is with us today. And we'll be talking with her about a new case.

University of Maine had to update their bias reporting system based on a letter that SLF sent over to him. But we've got breaking news with my dear friend, who is the author of one of my favorite books, Authoritarian, Mr. Jonathan Emor, who also, and I guess I need to get an update on this, is considering a bid for senator in the state of Virginia. So lots of news in my friend Jonathan's life. Jonathan, welcome. Good to have you.

Great to be with you. Well, so we've got breaking news with regards to a legal situation that you became involved in regarding a merchant there in Virginia, who was put under assault for having taken a stand against mask mandates and shutdowns and so on from Youngkin's predecessor. Talk to us about that situation and what's come of that. Then we'll flow into the Fauci thing. I want to ask some questions with you about that. And then perhaps we can also get an update from you on your senatorial exploration.

So this is truly remarkable. The prior governor of Virginia, whose name is Ralph Northam, had adopted a number of COVID restrictions like many governors did across the country without any action of the state legislature, just unilaterally assumed legislative power and really violated the rights of Virginians in spades. So, for example, he issued an executive order 72 that required every Virginian to stay in their homes between the hours of midnight and 5 a.m. and put all these impositions of mask mandates and social distancing and limitations on the hours of operation of businesses, including restaurants.

And the effect of those were devastating, economically devastating. And in May of 2021, that same governor, Democrat governor, withdrew his executive order imposing those mandates. And then in December of 2022, the ABC board, Virginia ABC, the regulatory board over alcohol in the state, conducted a raid on a restaurant called Gore Melts in Fredericksburg, Virginia, with 25 armed policemen and seized all the alcohol and informed the owner, Matt Strickland, that his license was revoked. He had he no longer had a license, actually, as of the time they raided him. But so anyhow, to make a long story short, we petitioned the governor on behalf of Matt when we were first informed of this raid. We were hired, actually providing the work pro bono for him.

Okay. And and we petitioned the governor to act. And the governor did act.

Governor Youngkin, Governor Glenn Youngkin, and I'm grateful for that. He issued an executive order, which required every agency in the state to report to the secretary of finance in the state every action that had been taken under the executive orders against any person that resulted in a fine or a revocation of license. And then he said that he he would amend his budget bill, which is a must pass bill that was that was filed with the legislature on December 15th to require reimbursement of those who had their funds taken from them and reinstatement of their licenses to the extent that they were revoked.

And he condemned the actions of the prior governor under those executive orders. And I salute Governor Youngkin for that and the attorney general, Jason Mioris. But to make a long story short, armed with that tremendous assistance and with the good graces of a good man who was the chief counsel to the ABC board, I I'm pleased to inform you that as of today, on December 23rd, Matt Strickland will have his license back. He'll have all of his alcohol returned to him, except for that which is spoiled.

And and he and he'll be able to go back into business and start and start being a restaurant again. Yeah. So that was a complete victory route. Yeah, the prior governor's action and really a very successful movement towards justice here. And I I want to thank all those involved in the in the whole thing, particularly that chief counsel at ABC, who I think was very professional and quite conscientious, actually.

And it worked out just fine in the end. And this is the reason why the people of Virginia, Jonathan, voted the way that they voted in this previous election with Governor Youngkin and and Lieutenant Governor Winsome, because of the fact that that these draconian and authoritarian acts had had been committed. Right. And I think that the future is bright for Virginia.

I think those things are indicative of a strong governor and of a governor who's sensitive to the needs and interests of the people and who will protect their rights. Right. And he's he's proven that. And so is the attorney general, Jason Meurs, in fighting against critical race theory and in fighting for parents rights, a lot has to be done there.

The battle is certainly not over its beginning, but it can be it can be won for sure. And it's a critical thing that needs to be undertaken. Parents rights, control over their own children's education, upbringing has to be restored or we have we're going to see and are seeing the ruination of generations of youth. Well, and the and the and the connectivity to that, Jonathan, is is is the is the Fauci regime, which we want to talk about the Biden regime as it sits right now, the current attorney general, Mayorkas and and and the declarations that they've made about parents as domestic terrorists.

I mean, these are the kinds of draconian and authoritarian issues that we are facing in our country today. And so if you could give us some updates regarding that, you've written a piece about the Fauci situation and you've tied this to some very interesting history. Can you speak to that for a minute, please?

Yes. So Trofim Lysenko was a scientist in the former Soviet Union in the late 1920s. He developed out of whole cloth virtually no scientific evidence whatsoever. A theory that overturned Mendelian genetics that was the rage then and it still remains today the foundation for genetics. But what he said was that plants, among the many things, but plants would would adopt the would adopt physical characteristics defined by the experiences of their plant progenitors, of their parents.

So parent plants would be quest to their offspring plants, their experiences, such that those plants could adapt to different environments. Now, what Stalin used this as he used it as a as a as a form part of the form of protection and and and propagandizing in favor of the mass collectivization of farms. Remember, he moved all massive people, took millions and relocated them into areas that were arid. Right.

His argument was look at Lysenko. He's established the science. The arid areas can be like the Garden of Eden because plants adapt and they do it based on the experiences of their parents. So they planted all these things in arid areas. It all collapsed.

People starved to death in huge numbers. And that is part of the legacy of Lysenko and of Stalin. Well, in like manner, we have witnessed over the last several years Fauci lie to the American people over and over again, demanding action on our part without scientific support and proclaiming himself. Like Lysenko did in service to the Communist Party, proclaiming himself science and pretending, right, pretending as though there is they wanted to make us believe they had scientific evidence when, in fact, they knew. And now it's been discovered Naomi Wolf has come out and and and her team has gone through all of this information, but they've come out and proven that they already knew that what they were saying to us was lies. And we were talking about this in the green room before we came on air. Fauci's counterpart, Dr. Deborah Birx, states in her book, yes, we were lying.

We got about a minute before we go to this break, but go ahead and tease us into the next segment, if you would. Well, Fauci is quite definitely one of the greatest betrayers of America in our history, and he is responsible really through gain of function research for the virus in no small measure and also for empowering an enemy of the United States to give them a bioweapon and also for a million American lives that have been lost a million plus. Yeah, because of all the lies, because of the initial action to cause the Wuhan lab to do this, you don't give an enemy of the United States that is under PLA control that is dedicated to our destruction and has a bioweapons program. The grist, the very means to create a bioweapon. Absolutely.

It walks us through the history of how we have gotten to this place. And we were talking about that in the break, Jonathan, and you were leading us into that. But here we have this situation now where they have taken over.

As you mentioned to me, people are waking up to what's been perpetrated upon them, but they have such mass control. I was mentioning to you that I had had to go down to the doctors and on the way back had gotten out to use a restroom and took a minor fall. And I hit my head.

And I've had some, you know, a little bit of lightheadedness, what have you. But I have been incredibly hesitant about going to a hospital or something along that line, because I don't want them to be telling me, well, you're mandated to take the shot or we won't see you. And I see stories about that here in Texas and all across the country. Hospital systems that are saying unless you take the shot, our ER doctors won't serve you.

Well, I would hope that you are able to get the medical care that you need. But it is a horrible thing. I mean, people have been turned away for liver transplants, critical heart operations because of an absence of vaccination. Some actually have essentially been consigned to death because of the refusal to be vaccinated.

And this is outrageous. Freedom of individual choice reigns in this country or has historically and is protected by our Constitution. Individuals who approach a hospital for years who have not taken care of themselves overtly, have alcoholism or drug addiction, have gone in and have been cared for by physicians because that's their oath and that's their duty. And so here in this highly charged political environment, which the president of the United States has made those who are not vaccinated essentially enemies of the state, declaring them to be the source and cause of the spread of COVID, which is an absolute lie. It's the same lie that Fauci told. The idea that only those who are vaccinated will not spread the disease was a lie. The idea that the unvaccinated spread the disease exclusively was a lie. The whole idea that masks would prevent the transmission of the disease was a lie.

The idea that double and triple masks would prevent the transmission of a disease was a lie. The idea that children somehow are at high risk and at risk of transmitting to adults the virus was a lie. They predicated their demands for vaccination of all children on this notion. And now we, of course, know based on the evidence from the companies themselves that the adverse effects associated with these vaccines have been profound and have really hurt a number of young people. And that the benefits of the vaccine for young people, if they could even be attributed at all, vastly exceed the detriments and that there's no sound justification. Children do very well with the virus and they get natural immunity from it. The other lie, of course, Fauci told and the administration told was that natural immunity was not assuredly a source of protection when in point of fact, natural immunity is the best protection against the virus. And always has been. I mean, you and I grew up in the days when, you know, if you got the measles or the mumps or what have you, if somebody did in your neighborhood, you know, mom sent all their kids over to John's house or Greg's house, you know, to get it while everybody was getting it so that that way everybody's immunity was built up and it was done and it was over and it was finished.

And then you treated the fevers or what have you and everybody moved on. I mean, that was just commonplace. Little Lord Fauci, if he is put under a microscope and I believe that it will happen with the Republican majority in the House and they scrutinize his entire career, what they're going to find and what is already evident from the evidence that is available in the email correspondence from Fauci to others, it's very clear that this man perceived himself as a person who could not suffer any dissent from his opinion. In other words, talking about a person of such extreme arrogance that the fundamentals of science, which are debate, the science is predicated upon a robust open wide debate about matters. Science is rarely definitive in the sense that within a few years, there's usually a revolution that overturns the paradigm that was adopted a few years later by consensus. So science is evolutionary and he wanted to make it static. He wanted to make it his own opinion. He wanted to run out of existence.

Any scientist who competed with that opinion and got attention. So he has worked his whole career to build an empire within government and to drive out of existence competitors. And he's been very evil in that regard.

And this whole movement for the Wuhan lab to do gain of function research. He's behind it. He was intimately involved with it. And he should bear the consequences of it. Absolutely.

One hundred percent. And we are are prayerful and hopeful that that will happen. And we're grateful for men like yourself that are that are out there leading leading the charge in that direction. We greatly appreciate it.

And I'm so glad to have with me Cece O'Leary from Southeastern Legal Foundation. Welcome, Cece. Good to have you back. Thanks for getting here and being with me. Thanks for having me. It's great to be back. Well, we got some good news, which is something we don't have a lot of these days with all the things that we're battling and all the things that we're finding, but it's so nice to have a bit of good news. It didn't start out that way, but you guys have fought the good fight, of course, and this has to do with the issues of bias and free speech.

And, you know, I had Michael Morris on yesterday, and NewsBusters has done a great job, MRC, of identifying so much of the bias that we're seeing in media and just in free speech. Still, I am banned on Twitter, LinkedIn, Vimeo, and restricted on Facebook. You know, shadow banned. I mean, it even says, you click on it and it says they can't see this, but you're restricted. I click on it and it says your account will be shadow banned for the next 16 days. And it's like, okay, then.

But so talk to me about what initially happened and then what your team was able to accomplish. Yeah, we noticed that like many universities across the country, the University of Maine was maintaining a bias reporting system. And the way that these bias reporting systems on campus work is that colleges will have a reporting form, and they encourage students to report each other using this online form anytime they feel offended by what other students either do or say. And then these colleges, like the University of Maine, also have a bias response team.

So when they receive these reports, this response team, which is made up of the dean of students, the director of residential life, all of these kind of higher-up administrators, they then investigate these reports. And so this creates this culture of censorship and cancel culture on campus where students are just tattling on each other all the time. So we sent a demand letter this fall to the University of Maine warning it that its bias reporting system was unconstitutional. And we said, look, you either need to completely take the reporting system down or you need to change some things so that it falls within the First Amendment. And we explained that you need to clarify that your bias response team cannot take any action against students who are reported for their speech. You need to upload a free speech policy to your bias reporting webpage so that students understand what their rights are and that they cannot report each other for engaging in protected speech. You need to clarify that you will not investigate students who are reported for engaging in protected speech. And sure enough, this week the university did update its website to make those changes. So now they have a disclaimer saying our bias response team is powerless.

We cannot actually take any action when we receive reports about speech. And they also included a link to their free speech policy. So now students will understand the extent of their rights on campus. So this is a big legal victory, not only for students at the University of Maine, but across the country who are battling these bias reporting systems.

It's interesting because, I mean, this is really very similar to the kinds of stuff that we've read about and that I know exist within communist countries, right, where it's report your neighbor because they say something that is in disagreement with party line or party speak. And, you know, with this new disrespect for marriage act as an example, I mean, this is going to become a really significant issue which makes this victory all the more important. Sure, and same thing with the proposed changes to Title IX. That's a big concern, and there's a lot of overlap between that and these bias reporting systems because the Biden administration is not only trying to change the definition of sex, but they're also including new things like stereotyping and belittling other people counts as a violation of Title IX. But how are students supposed to know what counts as something that is stereotypical or what counts as belittling someone? How are they supposed to be able to guess what offends other people? The risk here is that students end up self-censoring. Rather than risk offending someone, risk being reported to these campus thought police, they end up just choosing silence. And so that's the real risk with these bias reporting systems and, like you said, with the censorship that we're seeing coming from the Biden administration.

And so we're doing everything in our power to stop it one step at a time. Well, I'm glad you brought up Title IX because I think that's something for us to revisit this morning a little bit, and in particular the idea that it's a court outside of the court. So you have non-qualified individuals who are going to make court-type judgments not predicated on a presentation of all of the evidence, but on a presentation of only the biased evidence, and then they're going to make binding decisions, again, that have very serious legal ramifications for the future of a student in not just a university system, but the universal university system.

Did I explain that correctly? You got almost everything correctly, but one thing I'll correct is that it's not a they who are doing this investigation. It's one person under this new rule. There is a single investigator under these proposed changes who has the sole authority to do all the investigating themselves, all the punishing themselves.

They can recommend whatever discipline they want to recommend. And so that is very concerning because everybody has a little bit of bias one way or another. That's why our court system is so effective the way it is with juries and everything. And so they're trying to completely erase due process and change this entire system that has been working on college campuses over the past few years. Which, by the way, should be mentioned, I didn't mean to interrupt, but it should be mentioned that there's been a battle in order just to get to the place that we got to because, again, initially with Title IX, it was incredibly one-sided as it began relative to the damage that was done. I'm trying to remember Michelle's last name, but I know that she fought so many cases where young men were unjustly accused of acts by young women who were rejected or their affections were rejected. And so their retaliation was to make a false accusation, and that false accusation would then stick with.

And that cuts both ways. So a woman who actually is a victim then has a problem because she knows that in bringing her case, because there have been all of these false accusations that have gone before, her case might be glazed over, so to speak, and then you have these young men who are not guilty, but the not guilty piece doesn't follow the record. What follows the record is the accusation, period. Right, and in 2020, a lot of this was resolved with the rule that was passed and went into law, and the Biden administration was trying to undo all of that, and it's kind of funny. Right now we're past the notice and comment period, and a lot of groups like ours submitted comments on these proposed changes. And several colleges and universities submitted comments saying, look, we're confused. The rule keeps changing.

We need something consistent, and these proposed changes are just going to contribute to even more confusion on campus. They're not simplifying things. They're complicating things a lot more. Well, it doesn't make anything safe.

That's the problem. It doesn't create a safe environment either for our young women or our young men, and at the end of the day, the bottom line here is this isn't why they're going to school. They're going to school to pursue their education. They're going to school to pursue their careers and prepare themselves for the future and these kinds of situations. And, of course, a lot of this goes back to what I talk about about morals and morality and all those kinds of things, which they claim you can't legislate morality, and yet really these kinds of titles, this is exactly what is being happened.

It's legislating, but it's really more immorality than it is morality. Yeah, and there's a lot of overlap between that and these bias reporting systems because colleges are already doing this. They have these anti-bias codes that say you can't offend other students, you can't misgender other students, you can't belittle other students, so on and so forth, and they use these vague terms, and students, like I mentioned, have no idea how to comply with these vague terms. They're supposed to guess what's going to offend their classmates, but offense is a very subjective thing.

There's no way to predict it. So to your point, colleges are already trying to legislate morality on campus, and unfortunately the proposed changes to Title IX are just giving them a green light and saying go ahead and continue doing what you're doing. Well, and again, as you're preparing for the future, critical thinking, right, debate conversations over how people think, what they think, why they think those things, the ability to present your arguments in a systematic way so that you can either persuade one way or the other. I mean, these are all a part of that educational process, and even within Christendom, iron sharpening iron. We're going to talk more about this. We'll be back with more coming up right after this. Title IX, and I'm so glad that you brought that up because I think that is such a critical issue with regards to what's going on on our campuses. What are some of the other cases that SLF might be working on right now that folks should be aware of and to encourage them to go to the site and get signed up for your email so they can follow?

Yeah, thanks for asking. So besides our 1A project, which is where we work with college students to stand up for their free speech, like at the University of Maine, we're involved in a number of practice areas, including property rights, as well as protecting civil liberties. So your viewers and your listeners may be interested to learn about some of our cases challenging critical race theory in K-12 classrooms. We're currently representing some teachers who have had to go to teacher trainings that are segregated or teacher trainings where they have to affirm that they need to become anti-racist and that they are inherently oppressors because they are white. So if your listeners want to hear more or learn more about that, yeah, definitely please check out our website, slfliberty.org. And for any students or parents of students who are listening, we also have some resources on our website for college students about their First Amendment rights.

So I encourage them to check that out as well. Now, I know that several years back, you guys were involved in a case where children were trying to sue the federal government over climate change by making the case that it was impacting the air that they breathe. Is that case still going on? Are you familiar with what I'm talking about a little bit? We've had some cases challenging the government regarding environmental regulations.

I'm not familiar with one representing children in particular. But yeah, those cases have settled. The government has backed down from some of those regulations that they are trying to pass. But we always have to keep an eye on the government, especially with the Biden administration right now and watching the regulations that they're trying to pass.

I'll have to look up and see if I can find that one. This particular one was a group of kids that were suing claiming that the government's lack of action on certain climate change restrictions was subsequently causing them injury. And at that time, the judge had decided to let that case go through, which would have massive implications, right? Because now you have the activists going the other direction. So if the activists don't have control of the EPA or the BLM or what have you to force certain things to take over your waterways and do those things, then they'll come from the other direction and they'll claim to be the injured party and they'll work as plaintiffs to come after it. And I know that you guys have been involved on both sides of those equations, whether by amicus brief or by bringing the suit itself and saying, hey, wait just a minute, these are extremely out of bounds and they have massive impact on everyone. Yeah, we certainly try to be creative with how we tackle these cases and who we represent and strategic with what we're bringing and what we're trying to challenge.

And I'm so glad, again, that we can have the conversation today that was good news about the University of Maine. And for those that are just joining us, go ahead, again, and remind folks what has happened with regards to this Maine case and the bias issue that existed. Yeah, the University of Maine updated its bias reporting system to clarify that its bias response team cannot take any action when it receives reports of offensive speech. So in other words, the university has admitted that it cannot punish or even investigate reports of students saying things that other students don't like to hear. So this is a win for students on the University of Maine's campus as well as for students across the country who are trying to challenge their own bias response team. And this really also plays into this whole idea of ESG, right, you know, when you think about it, right, the environmental, social, and governance scorings and how that is really an effort to try to clamp down and keep everybody on a particular party line.

You're exactly right. I mean, we're seeing it coming from all sides in all ways, working its way through colleges, working its way through Twitter, I mean, you name it. So the more steps we can take, the more action we can take, even if it seems like a small step here at the University of Maine, everything matters.

The video is pretty graphic. Justice for us seems almost impossible. It's not fun to watch somebody die, and they knew she was in mode of peril. They did not ask the hard questions. Why was the Capitol intentionally unsecure that day? The FBI had information about security concerns before January 6th. They're out for blood, and they're getting it. They appear to be winning.
