We have breaking news folks this is huge. The ACLJ has filed a major lawsuit challenging a California band. Remember that bad July 1 on singing and chanting in church we represent three churches in California. By the way they are in counties that are not under that major ordinance. It was announced later. Last week by governors which shut down. Basically almost 80% of the state.

These churches still are in the counties that can operate, they can still operate as churches. They have this mandate, where it says they must cease singing and chanting three along with ACLJ we represent them have taken Gov. Newsom the California health director to County health officials to federal court. This is a major case and look we have been very cautious on engaging the issue dealing with the local authorities and how they're trying to control the pandemic issue.

What was so outrageous about this particular case and what we felt like we had to take action, you already have a limitation in place, which were not challenging here in California and that's is not matter the size of your worship center or Cathedral unit about 3000 seat church or Cathedral and you can only have it says occupancy at 25% or 100 people, whichever is less. So, no more than 100 people thought 3000 seat church. You can have 100 people. But guess what those hundred people can do if there 100 yards apart. They can't sing. And if you're in a liturgical church where there's chanting synagogues, churches, mosques, for that matter Greek Orthodox Roman North Russian Orthodox river, but you can religion these religions yeah it is a Hindu and Buddhist no chanting, so it is a chanting man, no matter what the size of the facility. Now that is not narrowly tailored, which is what a restriction on free speech is by the way worship, singing, offering praise is constitutionally protected speech. I've been litigating those cases, the Supreme Court for almost 40 well-known out almost 40 years. What about bout with about 37 years, and we been successful including the Supreme Court of United States, and I say this because again we been very cautious took took to go after these cases where we know we understand the nature of the people are dealing with. But there was this case, there was absolutely no choice.

You had to do it that's right I mean this was again remember when we read through and initially California had put together a recommendations but not they didn't use words. That said, must they use words that mean mandate that it uses legal terms, you say must cease and that means that you have to stop or else your that's not a recommendation to do something that's not a you should do this or we believe it's in your best interest.

But when you say you must stop chanting, you must stop singing even in the churches that are allowed to operate at these lower capacities that you must do that California has set itself up for this legal challenge they could do the right thing and come back and say they use the wrong language but if they are trying to fight this in court. They got real constitutional issues. Newsom the California Department of Health on singing in church and chanting in places of worship we represent three different churches into counties and by the way, if you're in California and you're thinking, but I thought all place of worship were shut down. That is not the case in Butte County, Montecito County, they have not face that order. Yet the came after this order, so there's still allowed to have in person.

Indoor worship services and yet they face this bad from singing or chanting because the language used on June July 1 was lost cease. You must cease singing and chanting not you should not. We suggest that you must.

One of the things that were concerned about Jordan here and and I and I like about coming on this too is this real focused attack on singing not you can wear a mask and sing, you can stand in most of these churches 200 feet apart. That's right that's right me there so few people even allowed to attend the service, which is another issue in itself, but you can you can do this with social distancing. I you can again the idea that if you're going to allow people to assemble at all inside. Remember, coughing, sneezing all that that's what they can to compare singing to that can happen in a moment at any time and and a lot of people are asymptomatic anyway, so this idea though, we have to remember that religious liberty is specifically protected in United States liquor stores, art, no big-box stores, art.

But religious liberty is specifically protected. She's got both the free exercise clause you have the establishment clause violation here and you have the 14th amendment equal protection. She's got the civil rights issue as well that you can't target.by the way the other businesses that are allowed to operate in these these counties right now. They don't have a ban on singing or chanting just just places of worship.

I want you to know that you matter to those who want to express themselves. God bless you keep doing it. Your range is real. This comes from our governor of the state of California, who while he's encouraging protesters. He's telling people in church how they can worship and how not to worship and whatnot allowed. What a crazy world that we live in a I don't know about you but I don't think I ever seen such a violation an infringement upon religious liberties as this is what so the irony of this is, and I noticed I was you know me for two decades I been doing this for decades and I have defended those protesters and straights who are chanting and holding signs and and I like say and I will say again that they have is always not violent. It's been the perfect right to do it. It's free speech is protected by the Constitution.

If there was a band that said you can you can meet on the streets, but you can't say anything or can't note chant. I would say that's unconstitutional.

I go to court to defend them if they needed this. I believe in free speech. But here's the problem they have taken a very different it's like there's two sets of rules. There's free speech if it's a popular protest movement.

There is no freight free speech and free exercise of religion, freedom of assembly.

If it's a church or religious institution that's in this by the way impacts synagogues, churches of all different denominations. Other religious groups as well. But Bob, it seems to me there are two different sets of rules. There are and will we went to great efforts to search social media order statements in the media by the governor by the county officials show is one of the display. The fact that there is this double standard and were doing so if you go to the complaint that you'll see exactly what were talking about. Again, we've been able to show a very clear, distinct treatment that is being given to churches uniquely telling them basically censoring them and telling them you cannot worship in a way that Nana got dictate things you're doing. As I said, if you have chanting going on the streets protectable zones is a nonviolent summary where mass some of them are not wearing masks so protected speech notes? When that's the only focus when they don't say hey when I can have singing or chanting anywhere were to just do it for places of worship at that is when again you've got eight a focused in attack and its discriminatory and and again you cannot do that you cannot you can't focusing on just those who are religious, and yet dad and Bob knows us to the reason why our organization to exist is time and time again governments, especially those left-leaning governments feel like they can do this that they can generate religious people differently and that somehow their beliefs like the importance of we talk about our brief of singing to Christians in their faith that that those beliefs don't matter, but give the protesters they do, yet will I think look, I think we done a really good job and Bob's teams and our team together done a really good job of laying this out but I really got to Ms. Lett. But this is a specific attack on people of faith and religious institutions. Yeah, that's right, I mean that that's the that is what is so outrageous here and we've got these three churches who were willing you know this is always so important as attorneys, we can fight these battles, but you've got to have clients who are ready to fight and to take all the fight that to your representative and they stepped up these three churches and they said we want to challenge the state of California to challenge Gov. Newsom's order. We want to be able to legally see and and practice our faith. The way our faith tells us to. We want to be able to have our worship service and worst trying to comply with the laws that would put in the rules that would been put in place, but that this goes to far this goes over the line because you're just targeting us. You just targeting religious people. So I think for Calvary Chapel of UTI Calvary Chapel, Fort Bragg, as well as edit with those coyotes who got in in Montecito County as well as River of life church. We have to think them as well.
