We were streaming till 1 a.m. Eastern last night with so many of you. And we were up very early. I did not sleep very much last night. We did eight hours of streaming total yesterday. We are back in the chair.

Okay. What happened last night? Let's talk about the gold market.

What happened last night? Let's remember how we got to this point. Donald Trump said, any time, any place, we are going to debate. Joe Biden saw in his internal tracking polls that he was falling behind Donald Trump. And understand the hubris and the pride of Joe Biden. They say, how on earth could we be losing to Trump? Oh, it's because people haven't seen the contrast.

They haven't seen the choice. They haven't seen me and Trump on the debate stage. And we need to get Trump back into that environment. We can kind of poke him. We can provoke him.

And we can narrow up this race. That was the calculus of the Biden campaign. That they've done all these things, that they've done the Infrastructure Act and deficit spending.

And they turned Easter into Transgender Day of Awareness. And if we were just able to have a debate of Biden v. Trump, everything would be better and the race would narrow. His advisors thought it was time to put him up on stage. And last night, for Joe Biden and the Biden campaign and Democrats across the country. That's right, Democrats top to bottom, from the Democrat run for dogcatcher in Mesa, Arizona, to Ruben Gallego, to Jackie Rosen in Nevada. Last night was the Hindenburg for the Democrat Party. It was a complete implosion. From the moment that the debate ended, CNN, John King said, I'm getting calls from senior Democrats that it is time for Joe Biden to drop out.

Now understand this. I first want to mention I thought CNN handed themselves shockingly professionally last night. Why? Maybe it's because there was an order that you have to conduct this correctly because we want to get rid of Joe Biden if he can't perform.

I don't know. There was no home field advantage for Joe Biden. Jake Tapper's questions were boring and rather scripted. The moderators were not part of the debate. They just kind of said, here's some general talking points, have at it. CNN also did not do Biden any favors by showing both candidates on screen.

This is very important. In previous presidential debates, when Trump was speaking, Trump would go full screen and they would maybe cut back and forth for a split screen. CNN made the production decision to show Joe Biden while Donald Trump was speaking. It was hard to even listen to what Trump was saying because you were trying to say, is Joe Biden okay? The visual was that Joe Biden was doing the mouth open while Donald Trump was speaking. And so Biden would be looking in different directions, left, right, up, down. And as far as television goes, historically, visuals are important.

This was a worse visual performance than Richard Nixon sweating after back surgery in the JFK presidential debate of 1960. So the split screen hurt Joe Biden tremendously. And then it was very clear.

And this is where it gets super interesting. As soon as the debate was ending, it is very clear that a CNN executive, probably in harmony and in symmetry with Democrat leaders, they gave the green light. You see, we were watching the entire debate with our war room.

Do we have a picture of the war room we could put up? We were clipping and we thought, wow, this is going great for Trump. And I said, do other people think this too? I mean, because you said Joe Biden is doing terrible, but you know, we're obviously partisans.

We're on team Trump resolutely. And Jack Posoback, to his great credit, we were doing a stream together. Jack says, I want to hear what CNN has to say.

I said, I don't know. But Jack's instincts were right. Yeah, we can put the war room up on screen. John King sent the salvo. He was the first tomahawk missile against the Biden campaign. Once John King opened the floodgates, the Rubicon was crossed.

Everybody on that panel, everybody at MSNBC said, oh, we can say that? What cut is John King? The first John King comment, which by the way, John King is a left wing journalist. He's somewhat fair, but he's very trusted by the intelligentsia and the ruling class of DC.

John King gave people a permission to unload. He basically said, I'm talking to senior Democrats. This is an unmitigated disaster. They don't think Joe Biden can do it. He's going to face calls to be pulled out of this race. He's going to face calls to get pulled out.

Unmitigated disaster. And I want to play the piece of tape here of John King. This is it. Cut 120. This right here was an ambush. My working hypothesis is that the media was willing to resurrect Joe Biden's campaign if he would have been passable. As soon as Joe Biden was hardly, hardly intelligible, the green light was lit and the dogs were released.

Play cut 123. Good minutes into the debate and it continues right now. It involves party strategists. It involves elected officials.

It involves fundraisers. And they're having conversations about the president's performance, which they think was dismal, which they think will hurt other people down the party in the ticket. And they're having conversations about what they should do about it. Some of those conversations include, should we go to the White House and ask the president to step aside?

Others are, other of the conversations are about should prominent Democrats go public with that call because they feel this debate was so terrible. And from there, the pile on continued. The ambush did not slow down.

It accelerated. In fact, I just took a picture of a CNN Chiron and it says Biden's disastrous debate sends reelection bid into crisis. Now, many of you say, oh, this was all a setup against Biden. Maybe, maybe. I think that some people on high wanted to try to see if Biden was as bad as they feared. Can they pull him?

But pulling him is a lot easier said than done. I'm going to get into that the best I can this program. John King continued. Actually, let's go to this one. This is Nicole Wallace, another regime appointed spokesperson like at 128. And there is a conversation happening inside Biden's circle and certainly a much more frank conversation happening inside the Democratic coalition. And I think there will be stories of a lot of concern about the performance tonight. And I think what conversations happening, what do you mean?

I think people are talking. I think the conversations range from whether he should be in this race tomorrow morning to what was wrong with him. Breaking news report, quote, all options are on the table.

Chiron right now. Now, it's tempting to say, oh, this was all a setup to try to get rid of Joe Biden. So let me get this clear. You want to have a summer debate where your entire party looks like a bunch of liars that you are filled with treachery and deceit that you've been saying Joe Biden is perfectly mentally fit. And then you have to, for the first time in American history, pull an incumbent president nominee before the nomination. So you wanted it this way?

Maybe. I think that now it is in front of them, the green light that was then lit and the dogs released, they have no choice. They have no choice but to try and remove Joe Biden, but only if Joe Biden goes willingly. If Joe Biden does not release his delegates at the Chicago convention coming up in mid August, and they bizarrely chose a very, very late convention, they could have chose the week after the RNC. However, the Olympics start close to that. So the Olympics, by the way, might have actually helped us out here. It goes RNC, Olympics, Democrat convention. That is the sequence of summertime programming.

The Olympics goes for about two and a half, almost three weeks. Who do they pull him with exactly? Oh, you might say Gavin Newsom. Why do you say that? Because he does a lot of press conferences? He's going to he's going to leapfrog over Kamala Harris. Kamala Harris, who is a black female, who is the base of the Democrat Party. He's just going to leapfrog it.

And by the way, other people, a lot of people in the Democrat Party don't like Gavin Newsom. This is a disaster for the Democrat Party. And the lesson for us is this. There is a game afoot.

The last 24 hours is the most hopeful I have seen from the Supreme Court decisions, which we'll get to Mike Davis in just a second to what happened last night. There's a lot of chatter about how terrible Joe Biden did, but not enough credit for how brilliant Donald Trump performed and allowed Joe Biden to hang himself. Do not interrupt your enemy if they are destroying themselves. This is a perfect piece of tape here that demonstrates this. This is 116, prepare it, where Donald Trump could have said, you are a senile and terrible and dementia filled person.

And it was perfect. This piece of tape is going viral and it should. And it's Donald Trump at his best with a gentle touch, just pushing Joe Biden away saying you're done. You're fired.

Play cut 116. The total initiative relative to what we're going to do with more border patrol and more asylum officers. President Trump? I really don't know what he said at the end of that sentence. I don't think he knows what he said either. Look, we had the safest border in the history of our country. All he had to do is leave it.

All he had to do is leave it. I don't know what he said at the end of that sentence. Donald Trump very well could have escalated the debate and Joe Biden was trying to provoke him with the losers and suckers hoax. With all that he's allowing, he allowed Biden to lose. And then there was this moment where Joe Biden inexplicably said, well, we beat Medicare. Trying to find that tape where he says, yeah, we beat up Medicare and Donald Trump responded beautifully. Well, yes, you did beat Medicare.

You beat it up terribly. What I love also was the message discipline. It was almost a running joke in the office. And it was brilliant on Trump's behalf. No matter what the question was, he brought it back to the border. They said, what is your opinion on child care? The border is wide open. What about climate change? The border is wide open.

Play cut 97. Making sure that we're able to make every single solitary person eligible for what I've been able to do with the COVID, excuse me, with dealing with everything we have to do with, look, if we finally beat Medicare. Thank you, President Biden.

President Trump? He's right. He did beat Medicare. He beat it to death. Perfect answer.

Perfect. He was talking about all the plays and we finally beat Medicare. I made this point last night, by the way, our live stream last night, just on Twitter X, I had 12.5 million views on Twitter X. And that is just on Twitter, on YouTube alone, half a million views.

NFL football games, increase in viewership as you get closer to the fourth quarter, increase.

So I'm one of those guys. If I don't really care that much about the game, I will watch the third or fourth quarter because I got other stuff to do unless I'm really into the teams really into the players. So it increased second quarter goes up after halftime goes up and then fourth quarter spike, close game.

Mahomes has the ball. Okay. Presidential debates are the exact opposite. Presidential debates start with extremely high viewership. And after about seven to 10 minutes, they go off a cliff. They just go straight down and they don't recover. They go down and they plateau because most people are not as political as we are.

They're not. So Joe Biden did not just do poorly. Joe Biden had his glitches in the moments where viewership was the highest. If Joe Biden would have glitched out at the end of the debate, it would have been bad, but it wouldn't have been nearly as catastrophic to the low information voters.

And don't take my word for it. According to a CNN post debate poll, 67% of viewers state Donald Trump won the debate. 67%. How are they going to pull Joe Biden? All options are on the table.

I have a theory of how it could possibly work, but this is a calamity for them. This is a mess. There are no good options.

None. There's ballot access issues, getting on the ballot in Wisconsin, getting on the ballot in Nevada, getting on the ballot in Georgia. There's convention issues. And let me be clear.

Is the party of democracy going to pick a nominee without their voters? This was the Hindenburg for them last evening, and they do not have a path forward. And it's time for us to go full acceleration and play to win. Hey, everybody.

When it rains, it pours everybody. There is so much drama and intrigue, and the next hour, you're going to want to make sure you listen. We have Vivek Ramaswamy and Ari Fleischer on the topic of polling Biden.

What does that look like? The technical details, because there's ballot access questions. There's Chicago convention chaos questions. Time is running out to poll Joe Biden in some of these states. But first, Mike Davis with some bombshell Supreme Court news, in particular, the Chevron decision and also the January 6th decision.

Mike Davis, welcome to the program. Mike, tell us about those two amazing bombshell decisions today. The Chevron case is monumental. The Supreme Court reversed a 40-year-old precedent where the Supreme Court instructed the lower courts to simply defer to unelected bureaucrats in these executive branch agencies when they interpret statutes dealing with their own power. So of course, these unelected bureaucrats, the Tony Fauci's of the world, interpreted these statutes to give them more power. And it created this problem where not only does the executive, the federal government have too much power, power that it doesn't have under the US Constitution, then that power was consolidated in the executive branch legislative power that Congress is supposed to have judicial power that the Supreme Court, lower federal courts are supposed to have.

And then they made it even more unaccountable in the executive branch by saying these executive branch bureaucrats were not removable by the President of the United States and unaccountable to the American people. So the Chevron decision is very, very important because it says that Congress must do its job and legislate and courts must do its job and interpret laws and we don't just defer to these executive branch agencies. Another big case that came out today was the Fisher case.

And the Fisher case is a big win for these January 6th defendants who are being politically persecuted by President Biden and the Biden Justice Department. President Biden and his Justice Department maliciously misinterpreted a post Enron obstruction of justice statute meant to go after corporate fraud that they used to politicize, they politicized it and weaponized it to go after Trump and his supporters. And so the Biden Justice Department got smacked down by the Supreme Court for this egregious abuse of power, these malicious prosecutions of these January 6th defendants. We also had a third case where the Ninth Circuit Court of Appeals, this wacky Ninth Circuit, said that it's cruel and unusual punishment for state local governments to outlaw homeless camps and public parks.

They wanna say it's cruel and unusual to let parks get overrun by tents and needles and drugs and garbage and filth instead of kids and families. The Supreme Court reversed that six to three. The only thing that was shocking about that six to three ruling is the three left wing Supreme Court justices are that crazy that they think that it violates the Constitution to clean out public parks from this garbage.

Mike, that was a really thorough analysis. Number one, I hope everyone understands these landmark decisions are thanks to Donald Trump. Donald Trump defeating Hillary Clinton 2016 and doing the work and standing by these nominees, very, very important. I wanna get into the Amy Coney Barrett versus Katanji Brown-Jackson because we're seeing some shit.

Amy Coney Barrett is quickly becoming a lib on the court, and that has been a buried lead. But first, Mike Davis, I wanna zero in on the Chevron decision. Does this now mean that the hundreds of thousands of federal code that has been ushered by the regulatory agencies the last couple of decades is now invalidated?

What are the consequences of this? No, this is going forward. The Chief Justice made it very clear in the Chevron decision that they're gonna respect what they call stare decisis or precedent on this statute cuz they decided this under the Administrative Procedures Act. And they said that the Administrative Procedures Act requires judges and not bureaucrats to adjudicate cases and controversies. That does not mean that 40 years of Chevron bogus decision-making is out the door.

It should be. Justice Gorsuch and Thomas would throw it out the door because if a court gets it wrong, stare decisis or precedent doesn't give them cover to keep getting it wrong when they got it wrong. Their job is to get it right. We're not the English common law in our federal system where the judges write the laws. And so you have to rely on the laws that judges write as the law of the land. We don't have a federal common law system like that.

So why should we follow precedent that is wrong, right? This is gonna be litigated through the lower courts for the next many years. But besides that point, this is a monumental decision. And this is going to start to devolve power out of the executive branch, devolve power out of the federal government back to the states and to the people where it belongs, as confirmed by the 10th Amendment to the Constitution.

So on this really important news day, I hope everyone understands, you know, talking about the debate is really important. This Supreme Court stuff is so critical. Mike Davis, now, secondly, the January 6, does that now invalidate or cancel out some of these convictions for the January 6 defendants? And what does that look like for these people whose lives have been ruined?

Mike Davis. Yeah, yeah, so the Biden Justice Department contorted, maliciously contorted, selectively prosecuted, politicized and weaponized this post-Inran statute to go after Trump and his supporters while they let BLM and Antifa and Abbas and abortion industry activists and trans terrorists cause a hell of a lot more death and destruction across our country than what happens on January 6. And they're putting people in prison for 10 or more years. One of these guys got 22 years in prison.

Now, there's a difference between the people who showed up on January 6, even if you think that they're wrong, even if you think that they're crazy, they have an absolute First Amendment right to protest government. Then there are people who trust past and they could be charged with trespass. And then there are people who are violent and they could be charged with violence. But to make up criminal statutes that go after your political enemies is unacceptable. And what's going to happen with this is you're going to see these criminal convictions vacated. Thank you, these January 6 criminal convictions will be, many of them will be vacated. And then the government, the Biden Justice Department is going to have to figure out if they're going to come up with another legal theory or if they're going to rely on the other charges that they got him on. But what needs to happen, this is, I think the American people see that this was political persecution by Biden and his Justice Department to go after Trump and his supporters. And on day one, President Trump needs to come in and give broad pardons to almost all of these January 6 defendants and the people who are violent, maybe you can reduce their sentence. But what the Biden Justice Department has done here by politicizing and weaponizing our justice system, this is political persecution, this is selective prosecution.

And frankly, the people who did this should face severe legal, political and financial consequences. So help me understand now Mike Davis, the Amy Coney Barrett trajectory, why is she voting like a liberal more and more often? What's going on with her? I would say this on the substance, she's not a liberal, she is, she's a law professor, and she's a rattled law professor. And sometimes law professors think that they're the smartest people in the room, and oftentimes they lack common sense.

And I think that's what's going on here is she wants to be the hand raiser in class and show everyone in the classroom how smart she is. And that might be cute, that might work if you're at Notre Dame Law School, but it doesn't work on the Supreme Court of the United States. I would say that Justice Amy Coney Barrett should get her law professor head out of her ass. So moving forward, Mike, can we just understand the political implications that if Donald Trump were to win another term, God willing, then we can have more of these major Supreme Court decisions in the future. And the Supreme Court, remember, is a lagging indicator of elections of the past, it is not a leading indicator. So you are now seeing the fruit of the 2016 election.

It's an eight to 10 year lagging indicator. Mike Davis, talk about how important it is to have positive individuals on the US Supreme Court. Well, thankfully, last night with President Biden, having diarrhea in his diaper on the stage, it looks like President Trump has a pretty clear path back to the White House, which is great because guess what, the next president of the United States could pick two, maybe three Supreme Court justices. And do you want President Trump or President Biden replacing Justice Clarence Thomas on the Supreme Court? Do you want a justice like Amul Thapar, who's an all star down in Kentucky, or do you want a DC Obama judge radical like Tanya Shotkin? The stakes could not be higher for this election for the Supreme Court because as you saw as you saw with these opinions coming out of the Supreme Court, these could be much different opinions if Trump did not win the White House back in 2016 and transform the left of center court to the Clarence Thomas Supreme Court.

We would still be wearing COVID masks and kids would still be doing Zoom classes, locked out of schools. When can we expect a presidential immunity decision? The presidential immunity decision will come out on Monday.

That's the last day that the court is issuing opinions and the Chief Justice said that that's the last day and so it has to come out on Monday. Get ready. It is a busy news week here. That would be three times the amount we're talking about. You see, it's so tempting, and we're going to talk about it all next hour. Who are they going to pull them with? How are they going to do it?

The media is freaking out. What an opportunity for us to say, while you guys are fighting amongst yourselves in the Democrat Party, we're going to quietly go to work and register more voters. We're going to go into the grocery store. We're going to go to the kids' ballgame. We are going to go knock on doors. We are going to say, boy, that new family just moved in, and they said they like hunting. They say that they go to church.

That's kind of a conservative profile. I'm going to go invite them over for a barbecue. And I know they just moved out of state. And that's a great thing.

By the way, that's a really good lesson for you guys. If you live in Arizona, if you live in Wisconsin, especially, if you have new neighbors on the block that have moved in from out of state, chances are they have not yet registered to vote. They're probably still registered to vote in their old state. For those of you that live in Arizona, and you know people that spend part time here, and they have an address here, try to convince them to register to vote here. In fact, I can tell you right now, one of my neighbors says, Charlie, I'm now officially an Arizona resident here full time. And I said, great, now you need to register to vote. He said, oh, yes, I've wanted to do that. Boom, plus one new voter this morning.

It took one text message. And so he's a high prop voter that was registered in Illinois, and he's moved out of Arizona. So new voters coming into the states is a great opportunity.

What I'm getting at is this. We are going to be covering the noise significantly. And July 11 is a huge day.

They might put Donald Trump in prison just because of all this. And we're going to explore that with Vikram Aswamy in the next hour. But what an opportunity for us to quietly go and do the work every single day.

Galvanize the base. And the opportunity is great. There's not going to be so if you were a Democrat right now, and you want to go register voters, that is a tough, tough terrain. Understand Democrats made their greatest voter registration gains in the summer of 2020. During Florida Palooza during the COVID stuff, they were able to narrow a lot of voter registration gains, we have now been able to expand a lot of the voter registration stuff to benefit us in Arizona, and many other states.

Right now is a unbelievable opportunity. It's a harvest. People are ashamed to be Democrats. They have a senile leader.

Only 33% of people who watch the debate thought that Joe Biden won, which I thought it should be even lower than that. But that's a separate issue. It is a movement versus the machine. And make no mistake, the machine is going to bounce back. They're going to figure it out. The Democrats, they're sophisticated, they have a ton of money, they are not going to just hand over the keys to the White House. They have a serious problem with Joe Biden. They have a serious mess on their hands.

They might not be able to recover it. But this race is going to tighten one way or the other. And when it does, we should then say I am glad, I am thankful I spent that Independence Day weekend doing work, not just hoping things were gonna get better. And doing the work is as simple as this.
