Hey everybody, welcome to the Charlie Kirk show.
Andrew Kolbe it in for one episode today at the Bitcoin.com mobile studio. We talk with Mike Davis from the Article 3 Project about the Maryland father hoax, the Maryland man hoax. And is Trump actually defying the Supreme Court and refusing to bring him back to the United States?
We talk about that and so much more. We also bring in Jack Pessobic. We talk about the Carmelo Anthony Austin Metcalf murder in Texas and why he's released on house arrest and what does that tell us? MAGA is ascendant. More Republicans are now identifying as MAGA.
What does that mean for the country and for Trump's policies? If this show means something to you and you get something out of it, please consider becoming a monthly subscriber at members.charliekirk.com. That's members.charliekirk.com.

Thanks for joining us to unpack this very contentious issue. It's involving the Supreme Court this time, so I want to make sure we get our facts 100 percent straight here, Mike. What do you make of this case involving the Maryland man? That's what they describe him as, the Maryland man.
His name is, I keep forgetting, so I've got to check my notes, Kilmar Obrego Garcia. So the press would have you believe, Mike, that since he's been deported to El Salvador at one of the prisons there, that the Supreme Court is demanding that he is returned. Is that true, Mike Davis?
Not at all. So remember, this Maryland's father, as the liberal media is trying to portray him, was found by a court to be likely an MS-13 gang member, one of the most vicious gangs in the Western hemisphere. He was an illegal immigrant who was in America for years. And then when he was about to be deported, he claimed that he was going to be persecuted if he went back to El Salvador. And my response is, well, now that we have a new leader in El Salvador, he's actually cleaned up the country where the murder rate has dropped significantly. And so I don't think he's going to face the same persecution that he once supposedly was going to face. And regardless, even if he's an illegal immigrant from El Salvador, MS-13 gang member, and he got sent back to El Salvador, right? Now, should he have been sent to a different country because of this supposed persecution? Maybe.
But guess what? A federal judge can't order the President of the United States to engage in foreign affairs with a foreign leader. That is beyond the judge's Article III power to decide cases or controversies with redressable claims with the parties before them. It seems like we're getting into some legal gray area. Now, the liberal media wants you to believe that Trump is a dictator.
He's an authoritarian. Now, he's openly defying the highest court in the land. Meanwhile, it seems to be that there's a lot of nuance in the actual ruling from the court.
And I want to play something that just came across the wire. It is surprising. The source is surprising, Mike. This is CNN's chief legal correspondent, Paula Reed, actually defending the Trump administration a little bit here, 196. And President Trump and President Bukele made it clear that Abrego Garcia will not be returned to the United States, despite this U.S. Supreme Court ruling saying that Trump had to facilitate his return. So are they just ignoring a U.S. Supreme Court ruling or is the fact that the ruling was so mushy, in your words, giving him an opening? It's a technical term I learned in law school, Jake.
Mushy. Look, they're working within the ambiguity that the Supreme Court justices gave them. They did not order the administration to return him to the United States. They said that they need to facilitate this return.
They could have said we order him returned, but they didn't do that. Mushy, Mike, is the word that she used. So when you read this court ruling, do you see what she's referring to, this mushy? So they're actually working within a bit of ambiguity provided to them by the court. Yeah, because no federal judge can order the president of the United States to engage in foreign affairs with a foreign leader. That violates Article Two of the Constitution, which gives the president, the commander in chief, all executive power. He is the chief law enforcement officer. He's the chief magistrate. He is the head of our foreign affairs, and judges cannot order the president to negotiate. When the El Salvadorian president was in the Oval Office, was a judge going to go in there and mediate the negotiation of this El Salvadorian MS-13 gangbanger who got sent home?
I don't think that's going to work. Mike, I love this moment from the White House, and I have the clip, so I want to play it. But you have President Trump surrounded by his cabinet officials. You've got Stephen Miller just spitting facts, by the way.
I have that clip too, which we should probably play. But then they asked—I think it was Caitlin Collins—asked Bukele directly, what are you going to do in this? And he just sits there. You can see the smirk on his face, going like, I'm not going to tell America to take back a terrorist that's already in our country.
Play cut, 201. Posture is not suggesting that I smuggle a terrorist into the United States, right? How can I smuggle—how can I return him to the United States? Like, I smuggle him into the United States? Of course, I'm not going to do it.
It's like, I mean, the question is preposterous. How can I smuggle a terrorist into the United States? I don't have the power to return him to the United States. I just love this moment because it's like world leaders that are actually running successful countries understand where the court's jurisdiction begins and ends, and they're sitting here laughing at it.
Your take on that moment and the importance of that interaction, Mike Davis, and we have another court case to get to, but your take on that moment. That's the point to these activist judges, these Democrat activist judges. Remember, President Trump campaigned on the fact that he's going to secure our border, and he's going to get these illegal immigrants the hell out of our country, particularly MS-13 gangbangers and Trende Aragua foreign terrorists, and he's doing exactly what he promised American voters he's going to do, and he's doing it very fast. These judges think that they're going to stop the President of the United States. They're going to turn around planes full of terrorists. They're going to order the President to negotiate with a foreign leader to bring back terrorists and MS-13 gangbangers.
It's not going to happen. This is the problem with these activist judges. They are lighting their legitimacy on fire with the American people. They look silly.
These are like 90-10 issues. They are clearly over their skis, and if they want to keep fighting the President on this, what's going to happen is the President is just going to ignore these lawless and dangerous orders, and then are these activist judges going to send their Green Beret law clerks to go get this MS-13 gangbanger out of the El Salvadorian prison? They don't have an army to enforce their order. They need to rely on the executive branch, and if they lose their legitimacy in the judiciary, the executive branch is not going to do their bidding.
Well, Mike, I want to pause there for one second. What you brought up here is pretty critical, and this is, if I'm playing devil's advocate, the constitutional crisis area. The left loves to use that framing. But if there is no highest authority in the land, are we advocating now for Trump to defy federal courts but not the Supreme Court? Where's the line? Is it if they make a ruling on foreign policy or immigration topics or cases that there is grounds to defy those? Where is the red line here?
Because we are flirting with a potentially problematic President. Look, the federal judiciary, these judges have a modest but crucial role to decide cases or controversies of the parties before them with redressable claims. Nothing more, nothing less.
It's really important. If we didn't have a judiciary, we would end up in tribalism. We need to have a forum to resolve our disputes. But these judges wear robes, not capes. It's not their job to fly around the world and right every perceived wrong. They have limited authority.
And when you're dealing with the President's national security, his commander-in-chief power, his running military operations or deporting foreign terrorists, the judges need to tread very carefully because when they overstep, the commander-in-chief has a constitutional duty to ignore clearly lawless orders that put national security in danger. And that's what happened. And I've never called for this before, but I did this with Bozberg. Making America Great Again starts with making America healthy again. Charlie Kirk here, I lost 40 pounds with the PhD weight loss and nutrition program. And two years later, I haven't gained a pound back. I started the PhD weight loss program because I need to be healthy to keep up with my crazy schedule. Most people start a weight loss program to get healthier. So why is Big Pharma spending millions to convince you to use their weight loss injections that do just the opposite? They have harmful side effects and lifelong dependency. Take a natural approach that isn't connected to a Big Pharma bottom line. PhD changes the way you think about food. They custom design a plan that is simple and works with your schedule. You'll learn to quiet cravings and finally release the unhealthy belly fat. You won't be hungry and you'll never take medication. That is myphdweightloss.com, 864-644-1900. Mike Davis, the Article 3 Project, everybody check that out, support his important work. We had another breaking news story, Mike, Judge Indira Talwani, I believe we have a picture of her, actually, if we want to scare folks at home. She just blocked Trump from deporting over 500,000 migrants flown in under Joe Biden's illegal CHNV order. Now Mike, the way that I'm reading this is that the ruling, and she's in Boston, Obama appointed judge, of course, she thinks that all of these 500,000 migrants deserve a court hearing, which basically means it would take 50 to 70 years to process them all to get them to go back to their own countries. What is the story here?
Can you make heads or tails of it for us? Yeah, so President Joe Biden illegally mass paroled millions of people, including these 500,000 illegal immigrants, essentially from Cuba, Haiti, Nicaragua, and Venezuela. And President Trump, by executive order, essentially gave them two years of amnesty, this parole for two years. And when President Trump came back in office, he's simply undoing by executive order what Biden illegally set up by executive order. And of course, this radical Obama judge from Boston comes out and says that, oh, no, no, you need to have a case by case review of each one of these 500,000 people. Well, Joe Biden didn't have a case by case review, he illegally mass paroled all of them. And President Trump is lawfully trying to get them the hell out of our country as he should. Mike, that's such a good point. So what the Democrats want you to believe is sane and normal and legal, is just mass paroling hundreds of thousands, and as you said, millions of migrants into this country. No vetting, no case by case, just a rubber stamp, get on the app, come into the country, you're going to be fine. Oh, and by the way, Mike, there's evidence here. The administration's own data shows that 72% of the CHNV, that's Cuba, Haiti, Nicaragua, and Venezuela entrants, accessed welfare within the programs within the first six months of arriving.
72% of these people. So there's no due process getting them in, just pure invasion. And we saw this play out in places like Springfield, Ohio.
There was a lot of illicit, I believe, criminal activity busing these people to these small towns, putting them to work at basically slave labor, wages, and disenfranchising American workers. So there's no due process, but now they want due process to get them out. So what happens here with this ridiculous ruling? The Trump administration is rightly calling this a farce and more judicial tyranny.
What happens now? Walk us through the next steps in the legal process to get this unscrewed. I think what Trump has to do is give them all mecca hats. And then if he makes them wear mecca hats, the liberal judges will get them the hell out of our country as quickly as they can.
I mean, this is absurd how this judge is ruling. You let 500,000 illegal immigrants come into our country illegally through mass parole. The mass parole is illegal. These illegal immigrants are committing a crime by being here. They need to get the hell out of our country.
President Trump campaigned on this. I used to be a lot more soft on immigration than I am now, but after 15 million illegal immigrants flooded our country, overwhelmed our communities, overwhelmed our social services, rampant crime. I have zero patience for illegal immigrants. Get the hell out of our country.
You guys are criminals. I couldn't agree more. Mike, I think everybody in the country feels the same way. I feel like everybody—I mean, if you go in your mind's eye, go back to the early 2000s or the 90s, and the posture that most Americans had towards immigration, it was mostly like, hey, we're a welcoming country, we're a generous country, and that generosity has been completely run over. It's been taken advantage of. It's been gamed by these NGOs, by these radical leftists.
Foreign money has flowed into this space, and we've seen the degradation of our communities, the dissolution of our cultural cohesion, crime rates through the roof. I mean, I completely agree with you. I think it's a large reason Trump won.
I think he's 100 percent right for doubling and tripling down on this and holding the line. I thank God every day that we have people with real courage in this administration that are willing to fight this fight, and they're not being cowed by these Maryland father headlines and the like. Mike Davis, tell us about the Article 3 Project. How can people get behind you?
I appreciate that, Andrew. It's article3project.org. You can donate there, follow us on social media. The most important thing your audience could do is take action. Right now we're trying to hold the federal judiciary accountable.
We want to impeach Judge Jeb Boasberg in D.C. for sabotaging an ongoing military operation to get the most dangerous terrorist out of America. So go to article3project.org. God bless you, Mike Davis.
Thanks for the time. Support his work. The American family is great again.

It's a great day with President Trump in office with this new administration pushing forward and actually holding the line for once for the American people whether it be standing up for the American worker against China, whether it's standing up for American people against the ravages of the illegal aliens and these criminal organizations like MS-13 and Trende Aragua. We've now seen President Trump standing up against them and the Democrats seem to always take the side of the criminal. We've seen it yet again and again and again just like we see in Maryland, just like we see all across this country. Well, and we see it with Carmelo Anthony, another story that's coming out. I'm gonna get into that with you in just a second Jack because I think that that story has there's so many layers to it and facets to it that I want to explore with you.
But I do want to pause on something you just said. And you said for once standing up for the American worker and for the American homeland against illegal immigration, it feels like, how do I say this, when the attacks, especially with this Maryland man hoax, they started coming from the press. It sort of felt like we've seen this movie before and I thought to myself, oh, here we go.
Here we go again. And then you get to that press conference in the Oval with Bukele yesterday, and you saw how forcefully the administration stood up and fought back. And then it just seemed like the energy was sapped from their side.
It's like, oh, they have a glass jaw. This is a paper tiger. These attacks that have kept so many people cowed in Washington, DC from doing the right thing for so long.
They don't work anymore, Jack. Are you sensing that? That we're actually getting the upper hand on the insanity and the media attacks on common sense? Yeah, Andrew, that's exactly right.
And so Charlie Kirk's audience knows this more than anyone else out there. But for having done the work of turning point action with the low prop voters and in the election and all these swinging states out there. Look, Trump goes seven for seven, he wins the popular vote. You see MAGA becoming more and more popular among the right and among even just sort of the average American out there.
Trump still walks into these UFC massive arenas and gets these huge celebrations. And this is even after the tariffs. This is after the illegal alien situation. Because I think last year on the ballot was this idea that enough had been enough. The things had gotten so crazy under Joe Biden and Kamala Harris people, you know, remember them, right? The media doesn't talk about them anymore. And about the millions of illegals, including criminal illegal members or members of these organizations that people said, You know what, we're done with this.
We're absolutely so done with this. We just want our country back. We want to get to some semblance of sanity, which by the way, is the exact same wave that brought Bukele into office and made him probably the most popular democratically elected leader I think in like, like American, you know, you know, continental, you know, North America, South America history wins with like 80% of the vote in his last presidential election.
Why is that? Because he cleaned up his country. He cleaned up the streets. He said, We're not going to let these gangs control our cities anymore and control our country.
I love what he said yesterday, by the way. It's not about the people that we incarcerate. It's about the people we liberate. And yet you never hear the media talking about that. You'll never hear the fact that Rachel Morin's murderer, right, this beautiful mother of five in Maryland, in Maryland, by the way, an actual constituent of Chris Van Hollen was her who was murdered and raped by an illegal alien member of MS 13. This guy was just convicted yesterday of that. And yet you don't hear Chris Van Hollen, the senator, they're talking about talking about her go and spend time with her family.
No, he wants to go down and spend time in El Salvador with a guy who never had any legal right to be in this country to begin with. I think they look like fools. I think the American people think they look like fools. It's a ridiculous hill for them to die on, but they've chosen it. So I'm more than happy to provide them with exactly what they're asking for. And I think when the American people actually take stock of what's going on, I mean, you've got these Obama and Biden appointed judges, basically standing in the way of very common sense practices of getting illegal gang members out of our country. And yet they keep throwing up these roadblocks, the newest being this CHNV program, these parolees. It was an illegal program that Biden instituted that let in hundreds of thousands of Cubans, Haitians, Nicaraguans, and Venezuelans. And now they're demanding a court hearing for everybody to go back. And it's like, that's 500,000-plus people that don't belong in this country, that filled our communities like Springfield, Illinois. And now they're going to basically try and suggest that it's going to take 50 years of due process to get them all back out. Not going to happen.
President Trump and the Trump administration is going to fight that tooth and nail. But when you say, Jack, that the left is always and predictably on the side of the criminal, we have another instance of this, and that's Carmelo Anthony out of Frisco Memorial High School in Texas. Now, there was a judge, I'm going to throw her picture up, because of course, let's go to 175, that's her image. This is Judge Angela Tuckett, who lowered his bail from $1 million down to $250,000.
And Jack, you know the details very well. There was a GoFundMe that was getting a lot of traction, and they raised a lot of money. So now Carmelo Anthony is out on bail.
He's on house arrest with an ankle monitor. And there's some belief, I don't know if it's been confirmed yet, maybe you can fill us in, Jack, that they have also used some of that money to buy a new home for the family. Jack Basobek, your take. That's exactly right. Now, this is a Give Send Go. So Carmelo Anthony had a GoFundMe up at one point, that was taken down. Give Send Go has put it up. Remember, Give Send Go is the same organization that ran the crowdsourcing for Daniel Penny.
I believe they did Daniel Perry, Kyle Rittenhouse, many others, the Jan Sixers, and they have a no cancellation policy. So they've got this up for Carmelo Anthony. Now, when you look on the site, it says that it's for the family, the official fund. The site has been referred to as a legal fund. Their advocate that they've hired is also referring to this as a legal fund.
And in fact, the officials at Give Send Go do it as a legal fund as well. And yet we've also heard that the family's advocate now coming out and saying, you know, this BLM type guy, not Ben Crump, but sort of like a Texas version of Ben Crump, has come out to say, oh, well, the family is facing racist threats. And so they're going to now be using this funding that they've raised in the name, by the way, of his legal defense to be moving to a new home because of the racist threats they've received. Well, that sounds a lot like they're taking the money and buying a new house with it.
And that's exactly what we saw BLM and Patrisse Cullors and so many others do on off of the backs of the names of George Floyd and Breonna Taylor and so many others where they would take the money and use it to enrich themselves rather than support, by the way, the family of George Floyd or any of these people that in fact went into their own pockets. By the way, this advocate himself for the family has also Dominique Alexander has been as extensive, by the way, rap sheet having been involved in numerous cases of domestic violence, including at one point the beating of a toddler for which he did serve jail time. And so, you know, you really look at this situation and it's it looks as though it's it's perverse incentives. It's a situation where again, there's no Carmelo Anthony Austin Metcalf situation.
There's no evidence whatsoever of self-defense other than rumors and misinformation that have been spread by Carmelo Anthony supporters in order to gain money. And it seems as though what they're doing is they're taking the murder of a young white athlete and using that to enrich the family, the advocate and anyone else who are potentially associated with this this fund and raising money from it in the name of legal defense and then using it to line their own pockets for personal expenses. It's horrible. And by the way, stuff like this, they use it to enrich themselves. And we saw this with BLM.
And what does it do politically? It divides the country and it drives us apart. It should not be. This is one thing, by the way, where I agree with what the father said. We shouldn't view these things through the lens of race. We shouldn't through this view this through the anarcho tyranny lens of saying, oh, well, you know, all white people are oppressors and all black people are oppressed. How about you just view it as a situation between two teenagers having a fight and one decided to pull a knife and stab the other one and then base it given a colorblind, you know, justice is supposed to be blind, a colorblind application of the laws and statutes of the state of Texas as they are written.
I totally agree. I mean, and for those of you in the audience that are needing a refresher on what happened, I mean, it was essentially Carmelo Anthony sat under the wrong tent at a track meet. Austin Metcalf, maybe some others said, hey, you know, you're in the wrong tent. And he said, you know, basically, if you think I am, you go ahead and move me. So he got up and put his hands on him.
And Carmelo warned him, said you put your hands on me, like, you know, whatever, I'm gonna fight you back. So I guess he proceeded to push him out of the tent. Not exactly sure that all the details there, but it seems like a really run of the mill kind of scuffle and pulls out a knife and stab someone over a seat.
Killed him. Well, and Andrew, what we're also doing, by the way, is that there is video in this case that the police have, and a lot of people have now been pushing for the police to release this video. There's even been calls for Attorney General Ken Paxton of Texas, too, that if the, if the Frisco Police Department does not release it for him to get involved and say, please release this so that we can really get to the bottom of what's going on here. So I know a lot of people have been spreading, you know, different versions and speculation about this case. But I think that the video, when it comes out, and by the way, I'm sure the prosecutors have looked at this before they went to that first degree murder charge. I think that that video, when it comes out, will explain a lot. And I think it's very interesting, by the way, that these BLM advocates are not calling for the video to be released. Interesting. Yeah, great, great analysis, as always, Jack.

Use discount code Charlie to get 35% off plus free shipping. That is balanceofnature.com, balanceofnature.com. I want to get to a poll that just came out. And this is about people and how they associate with the MAGA movement. A lot of you in this audience consider yourself MAGA, part of the MAGA movement.
Go ahead and throw up 206. So back in January, about 20% of Americans said that they were part of MAGA. And that included 55% of Republicans. Now, that number is up to 36% of all Americans and 71% of Republicans.
And I believe that this is incredibly significant. Now, you don't have to be a card carrying member of MAGA to appreciate what President Trump is doing. But the fact that 71% of the Republican Party now identifies as MAGA is truly historic. And it's a landmark achievement for this president who took over the Republican Party in a very contentious way over the last nine years. This has been a hostile takeover of a Republican Party, a GOP that was dead and dying, that had no verve, no appeal to younger people.
It didn't have a cultural hook. There wasn't people doing dances in the end zone for the leader of the Republican Party. And we see this, even in off-cycle elections, midterms, how President Trump is a singular political and generational talent that's able to mobilize people that do not usually vote, people that are not accustomed to paying attention to the political process. President Trump is able to mobilize them, to energize them, and get them behind his mission. And what's most critical about this is that it shows his message is winning. Even when the media establishment, the institutional establishment of this country says, the sky is falling, tariffs are going to lead us over the cliff.
Guess what happens? Regular Americans rise up and they say, actually, I like what President Trump is doing. His mission is common sense. His goal is to restore the prominence, greatness, and wealth of America. And regular, forgotten America appreciates this and sees it for what it is. And as we were talking about with Jack Pszobek in the previous segment, they are saying to themselves, finally, there's an American leader who is standing up for me, who's standing up for the country that I love, the country that I will raise my kids in, the country I will die in, the country that means so much to me. Faith, family, and country are now being respected again. They're not being trotted upon. They're not being cast aside and ignored. And you're seeing this in cultural moments, the UFC fight, where hardworking Americans come out by a ticket to support something masculine, aggressive, strong, and they celebrate a president that walked proudly into that arena. You see it in even over the weekend, SNL was making fun of third rail topics that used to be completely off limits, LGBT issues and adoption issues. On SNL, you see MAGA ascend it.
You see that the president's goals, ambitions, missions, policies are popular, even when they are controversial, because we are no longer being cowed by the same sniveling, whining voices in the corner telling us, no, you can't do that. You can't have your country back. President Trump is proudly saying, yes, we can. Yes, we will. And I dare you to try and stop me. Thanks so much for listening, everybody. Talk to you soon.
