And she makes appearances all over the country on different news outlets. And I want to welcome Bethany Blankley to the program. Bethany, welcome. Good to have you. Thanks so much for having me. Absolutely.

Absolutely. It's been a while. It's been a while. Bethany and I, years back, she came on Fridays. And we did a segment of Children Generation Radio together.

So she is a part of the fabric and the history of our program. So good to have you back. Thank you so much.

All right. Numerous news organizations reported that Governor Greg Abbott declared an invasion at the southern border. You have done the investigative journalism on this. And is that is that a fact? Did he in fact declare it? No, he did not. No, he did not. So this is what happened.

And I'll give you some context. July 5 is when Kinney County, Goliad County, and Terrell County judges declared an invasion. And they did so. And Terrell County Judge Dale Carruthers was a lifelong Democrat. She recently switched to become a Republican and ran for Republican reelection as a Republican as a judge in her small border county. They have 1000 residents, and she won.

And so she was she's has a mixed race background. She is very adamant that what's happening to our community is an invasion. And so she's the first there were two men and one first female judge to declare an invasion. And so they called on Governor Abbott to use his full authority order under the invasion clauses of the US Constitution and the Texas Constitution. And the US Constitution is Article One, Section 10. And the Texas Constitution is Article Four, Section Seven.

And they each have something a little bit different. But basically, those are the clauses that they cited them in their declaration. So two days later, they forced Abbott to act. And two days later, Governor Abbott issued an executive order on July 7. And in the executive order, he uses and cites the invasion clauses in the declaration, but he's in the order, but he does not declare, he does not formally declare an invasion, but he invoked those clauses justifying his rationale for ordering the Texas National Guard and Texas DPS to apprehend illegal aliens who are in Texas and return them to ports of entry. Because right now what they're doing is they're along the line helping Border Patrol, they do not have jurisdictional authority to process any illegal alien, only three people in the federal government do, which is Border Patrol, a certain division within Homeland Security Investigations, and ICE. Or it could be, it's now I think it's renamed, I'm not quite sure, but I think it's removed within the removal office with ICE.

And then that's it. There's only three groups, three sub agencies that can process an illegal alien for removal and issue deportations proceedings or start or initiate deportation proceedings. DPS can't do it. Texas National Guard can't do it. So what can they do? Well, that's why they're assisting Border Patrol agents at the border with apprehensions. But if they catch people who are coming in between the ports of entry, who are crossing the river, not surrendering to Border Patrol, then he's authorizing them to bring them to ports of entry, hand them over to Border Patrol, who then processes them and then releases them. In addition to that, he's also ordered them to arrest illegal aliens who are committing state crimes.

And so the judges have said throughout Texas and others throughout Texas have said that's not enough. You're not repelling the invasion. Repelling the invasion means removing them from Texas. It doesn't mean handing them over to Border Patrol.

It doesn't mean putting them on a bus to New York or DC or anywhere else. And so after July 7th, many more counties started to declare an invasion. And so they did so in different ways. They voted with their county commissioners or a judge signed a resolution or they issued a disaster or they signed and approved a disaster declaration so they could potentially apply for Operation Lone Star funds. So there are different ways that they went about doing it, either with the county commissioners, the judge alone, voting on different measures. There's about three or four different ways that they've done it. And so far, there have been at least 33 counties that have done it.

I know several more are going to be doing it next week because of people I know who are working with them on the resolution. So this is the context. And they kept putting pressure on. So the more and more kept doing it, then Abbott was being put under pressure to do something. And so it was believed after he won re-election that he would declare an invasion.

But he didn't. And so what happened was, is there was a Navy JAB who wrote a column that ran on Thursday in the center square. And it's called Why Texas Must Declare an Invasion at the Southern Border. And Governor Abbott read the article, is what I'm told.

And then on Monday, which puts pressure on him even more. And then on Monday, knowing that Kerry Lake lost the election in Arizona, and she had already vowed that she was going to tell Texas how to declare an invasion because she knows what's happening at the border. And she doesn't believe that he's declared an invasion or knows how to repel it. So she's telling Texas she's going to do it.

Once he realized that she's not a threat to him anymore, and he's not she's not going to be governor. And then after Jonathan Houlihan's column ran, which has gone viral, then he sent a letter to the judges who declared an invasion on Monday. And that's what I initially reported on that ran early Tuesday morning. And within an hour of that story running is when he tweeted parts of the letter, but never made it clear that it was part of a letter that he sent to judges. And so everybody misreported, because they never checked the actual source, and they never fact checked what it was.

And the other thing that was very, that came across as very dishonest, that people have said, is that he tweeted this from his personal account. It was not on the official governor's Twitter page, it was not through an official press release. There's no there's no mention of any of this on the governor's website. And so when he's saying that he invoked these clauses, he's referring to what he said in a letter to the to the judges on Monday, citing his declaration on July 7.

So if he really had invoked these clauses, then how come he hasn't repelled the invasion since July 7? That sounds like a reasonable question to ask the governor. And I imagine there's a strong possibility that someone from the governor's office is listening to our program today, or certainly will be listening to our program at some point in time in the future. David, you're as a constitutional attorney, you're listening to what Bethany has shared. Essentially, the governor has not invoked his powers. So therefore, nothing really has changed, it sounds like.

That's exactly what it sounds like. Although I did see the tweet myself yesterday before the story. And I did get the impression that in fact, he had done so based on 180 characters.

And so, but I never saw anything else. He does have certain authority. I haven't seen the July 7th letter either. And it sounds like he may very well have done something July 7. But from that perspective, he does have authority to do these things, but has not taken action pursuant to that.

So it's quite confusing, at least to me, whether or not the July 7th activity, in fact, was a legal action. Texas is very interesting, on a side note, in terms of the authority of the county judge. Besides making judicial, they're also an executive officer as well. And they administer things within the county where they're judges. They have a different position than most people consider to be judges. And so the involvement of these county judges is extraordinarily significant from that standpoint. It's not like it is without meaning, because these county judges in Texas have more authority than most county judges in Texas.

More authority than most judges around the country, because they can act as an executive in addition to being a judicial officer. Bethany, where does this story go next? We'll see. Well, where it goes next is there are more judges and more commissioners that are going to be declaring an abation and a resolution. And that should most likely happen. I expect some of them to be doing it next week, at least three that I know of initially.

The other thing to point out is that on the same day that he did that tweet, he also officially announced through the governor's office that he was sending the first bus of illegal aliens to Philadelphia. And so there's no way that you're repelling an abation when you're also sending people into the interior of the United States. I agree. Hold that thought for one second. We got to take a quick break. The Center Square. There are a couple of articles. We're going to get them up on our site. Numerous news organizations misreport Abbott declaring an invasion at the southern border. Also, the op-ed by Jonathan Houlihan, Why Texas Must Declare an Invasion at the Southern Border. Let's jump off and talk into that for just a minute. You were talking to us about what's happening and what the attributes are of this invasion.

Bethany, would you share that with my audience? What is taking place? What are they doing and what are the cartels doing? One of the ways that we're trying to change or reframe the conversation to help people understand is that what's happening is similar to what insurgents are doing in Afghanistan or Iraq, that we sent our troops to fight, that our troops' American blood has been shed over this. That same pattern of warfare is being used at the border, across the border, and in our cities and our communities. They're using migrant warfare.

They're using unconventional warfare. What you'll find with Texas sheriffs that I've spoken to is that there are cartel scouts as far deep in some rural communities outside of Houston. What they're doing is they come in across the border illegally, and they look for areas where they can set up shops where they might fall underneath the radar, where they can wash their cash through bodegas, set up the stash houses for trafficking people and drugs. What happens is they move the people on the drugs north, and they've moved the cash and the weapons south and stolen cars. The good thing about Operation Lone Star is that the state troopers and sheriffs who are involved in it are catching people who are stealing cars and driving south to go pick up the illegals that they're trafficking.

They're going to come back and traffic north. They're catching people with the stolen cars. They're catching the human smugglers. That's who they want to catch because the Texas legislature increased the penalties. Now the charges for human smuggling are much greater because the cartels are advertising on TikTok, Facebook, Twitter. They just caught a guy who advertised $70,000 for somebody to drive an 18-wheeler that had 80 people inside. This is big money. As much as they can move everybody into the United States, they can set up their modern-day slavery and indentured servitude because everybody who comes across owes the cartel. Nobody has $4,000 or $5,000 or $10,000, I've heard even $20,000 from young men.

Nobody has that cash up front. The cartels have an incredible system they use knowing who these people are, knowing where they're going, and then capturing their wages, transporting them to and from their jobs. There are homes where tens or 20, 30, 40 people are stuck in there, maybe 10 or 15 people in a one-bedroom.

They hold their ID so they can't move. This is really modern-day slavery. The NGOs that are helping them move throughout the United States are participating in this. They're getting hundreds of millions of dollars from the federal government to do it.

It's a travesty. There are multiple things that are happening. So with all of this comes increased crime. The burden gets put on our local law enforcement. There's a reason why police in Houston are shot more than any other police. We have the highest number of cops being shot in Texas because Houston is the largest city closest to the southern border and because of the cartels. The cartels have embedded themselves in Houston, which has become the distribution hub for human and drug trafficking all over Texas and all over the United States.

Let me just jump in and say that I have been saying on this program and have had a guest come on to confirm this. Houston has been the number one human trafficking center for the last 10 years. For the last 10 years, it's been the number one human trafficking center in the entire United States. And yet, supposedly, we have conservatives in the governor's office, in the lieutenant governor's office, and as an attorney general, and they won't shut it down.

And there's absolutely no excuse. Something else that you said too that just hacks me off is these NGOs. NGO folks is a non-government organization, like, for example, the Catholic charities. Catholic charities are helping, helping the cartels to traffic and to send people all over the country. And whether they know it or they don't know it, they should know it because they're in the middle of doing it. Well, they're not doing it for free. They're getting a lot of money to do it. And they'll say that they're doing it to help people who are in dire straits.

But the question would be, would they be doing it if they weren't getting all this money? But to get back to your question, the issue that people need to understand is that this is not about illegal immigration. This is about national security and sovereignty.

And so the whole point of what the judges, what Houlihan, what others have been arguing, either Center for Renewing America, they argue the same thing. They're arguing that we as a sovereign state, when the federal government has abdicated its responsibility under Article 1, Section 10 of the Constitution, the state has the authority to defend itself and to declare an invasion and to repel that invasion. And that's why the judges are continuing to issue declarations saying that they're calling on the governor to use his full constitutional authority, which he hasn't done, to repel the invasion, which means dropping people's laws at the International Bridge, bringing them back to Mexico, or setting up the National Guard along the border, preventing anybody from coming in, which is what Allen West had said from the very beginning as a former lieutenant colonel in the Army. We have defended borders in Afghanistan, Iraq, we've built walls in all these other countries. We've defended the borders of other countries. We are not doing it on our own. It's the federal government's responsibility to do it.

It's not doing it. But it's the governor's responsibility as the commander in chief of their sovereign state to do it under the Constitution when the federal government abandons them. And that's what Carrie Lake's plan was. Her plan was to prevent anybody from coming in by bringing the National Guard there and shutting down access and entry to the border.

And you can do that on state land. And the reason why they haven't done it is because they're using a section in the Constitution called Section 242, which is the federal preemptive clause, and international law security and Navy JAG expert who did the same kind of things that DeSantis did. And he's now the lead attorney for county citizens defending freedom.

And he and I have been working on several things related to the border. And that's who wrote this column explaining that this is non-conventional warfare. Texas must declare an invasion because it's only going to get worse. What the cartels are doing is they're going to embed even deeper, and then they take over an entire area and it becomes more dangerous, which is exactly what the insurgents did in Afghanistan and why troops were killed. And so Americans are going to continue to be killed because of what's happening. Now, granted, this all falls on Joe Biden and Alexander and Alejandro Mayorkas.

It falls on them. But because they haven't done their job and are actually causing more chaos and more human misery and more cartel-related crime, the governors have the responsibility to protect their citizens. So you have four border governors and only two of them have done anything to try and to try and protect their citizens and to protect Americans. And as much as Governor Doug Ducey really didn't, a lot of people say didn't do very much, he still did more than any other Arizona governor had done in terms of raising the money and scourging National Guard to the border to help border patrol, not to repel the invasion, but to assist them and then building border barriers and some other things. And same with Governor Abbott, to give him credit or credit too, he's done more than any other governor to help law enforcement to keep our community safe.

And so the judges recognize that too. They're thanking Governor Abbott for all he's done. They're just asking him to do more.

He knows they're going to keep asking him to do it, which is why I believe he tweeted that out to make it seem like he's declared an invasion and everybody else because everyone outside of Texas believes that Governor Abbott is doing the most incredible things at securing the border. And so they don't understand the inside politics of it. They don't understand what's really happening. They haven't been to the border. They don't understand how the National Guard is being used. They don't understand any of that. So when Fox News blasted out, they're like, oh, wow, this is awesome. Governor Abbott did this, but hold on, back up the bus.

No, he didn't. And this is why. And it's important for folks to understand that because of the dangers that you just explained to us. We've got to take a break, but the dangers that you just explained to us, and we can talk a little more about that in just a minute.

Abbot's folks called the folks at the White House and the globalists and the open border folks, and they said, we got a great idea. We're going to march these people onto buses in broad daylight, and everybody's going to clap and wave their flags and cheer us on as if we're actually doing something, when in fact what they're doing is they're simply further assisting the cartels in taking these illegal criminals and shipping them up.

And how crazy is it now, just popped in my head, but think about it. Venezuela has sent militia, and who is it that the whole lawsuit and the attorney and all that nonsense that was going on up north, who were they talking to? I don't know. Venezuelans. I mean, come on, people, seriously.

Seriously. It's right in our faces. They're doing this right in our faces, Bethany. Well, on the same day that Abbot tweeted that he was invoking these clauses in the constitution, and these clauses were devised by our founding fathers in Philadelphia, he announces on the same day that he's sending illegal aliens, the first bus from Texas, to Philadelphia. So there could not be anything more ironic or hypocritical as people have given me quotes in a story that's also going to run today about the first bus that arrived in Philadelphia this morning, which is a follow-up to the news report misreporting that he declared an invasion, because what should naturally happen if you declare an invasion? If you're really invoking your full authority, then you would be repelling the invasion.

And if you're not repelling the invasion, you're going to keep seeing the caravans of all the people coming through. So if he really invoked his full authority when he issued the executive order on July 7th, he would have been repelling the invasion since July 7th, which he has not done. But yet yesterday, on the same day, he says he's doing that, he sends the first bus to Philadelphia. And that's why people in Texas who have been calling on him to repel the invasion knew that that was a ruse. And why?

Why? Because he knows that the judges are going to keep calling on him to repel the invasion, because they are. All these more judges and county commissioners are working on putting together invasion resolution.

They're not done. They're inundated in their communities with the crime. Their court systems are backed up.

Their citizens are being attacked. Well, and something too, you know, we just had another custom and border protection suicide over the weekend. And, you know, this is a direct result of these policies. Yep, it's a direct result of Biden's failed policy. And to some degree, it is also that there is also some blood on the hands of Greg Abbott and the governors along the border who are not taking their responsibility.

Because again, you know, David, and we talked about this, right? You know, you have powers that are delegated to the federal government, and obviously border protection is the main reason defending our nation. But if the federal government won't defend our nation, then states have the right to defend themselves.

And that falls, as Bethany has said, to the commander in chief, which is the governor of the state. If they don't do it, then we the people, our rights are what are infringed upon. And they leave us in a position where ultimately, we have to take some kind of action to protect our own properties.

That's a fairly good summation of legal circumstances, Greg. What I would certainly suggest is, yeah, they do have, they do, the governors do have such authority. They need to exit, they need to exercise it. Because if the governors do not, and the president will not, there is in fact no country. That's what, that's what in fact defines the country. As Bethany mentioned, there's so many places overseas where what we've done is actually defend the borders of another country. And that's, and having borders is a singular definition of a country. And that's what the invasion clause in the United States Constitution is about. Of course, everybody can refer to the preamble when it says the purpose is to provide for the common defense. And in terms of providing for the common defense, failing to turn these people away at the border, just turn them away at the border, is an absolute failure of the first principle, the first duty of the government of a country.

Bethany Blankley had joined us on the program with some really breaking news and exposing the truth about what is actually happening and what Governor Greg Abbott did and actually didn't do. And what he has not done, what he truly has not done, has invoked the invasion clause that would allow him to be able to empower National Guard, to put National Guard on the border, to start having National Guard actually build the wall and seal the border and shut down the invasion. And he can. He has the constitutional right to do so. It's actually his responsibility because the federal government has abandoned their responsibilities.

They're derelict in their duties. And as a result of that, the governor of Texas, as well as the governor of Arizona, the governor of New Mexico, the governor of California, the governor of Florida, and any of these areas where you have this influx in Florida, they have an influx coming in of people trying to cross over from Cuba and even, you know, swinging around from Mexico. You have illegal immigration going on in Florida. So you have, as Governor DeSantis would have, the right to be able to do that.

But the major areas are Texas, New Mexico, Arizona, and California. Obviously, Newsom's not going to do this. Kerry Lake was going to do it. There's still a battle going on there, but it has been called to a degree and they're saying, no, it's over, it's done, it's finished.

And if they get into a recount, the current governor is also the, or the person who would be the governor happens to also be the secretary of state that actually is going to oversee her own recount. Give me a break. Anyway, David, so that kind of, that builds the bridge into the election issues.

Talk to me about what happened. I know, right? That really does it. And then of course, it all does come ultimately down to elections and problems that go back to motor voter. In 1993, I was at an event last night and there was a guy there who said he was at the board of elections in downtown Chicago and it fell in line in front of him, talking to a clerk there, said that I wanted to, I wanted to withdraw my registration as a voter and he went to find out why and the guy was nice enough to talk to him and said, listen, I came here legally and I went and got a driver's license and somehow or other, I started getting in the mail election material and I got my election card and I am not a citizen. I want to be a citizen.

I don't want this phony registration. So somebody actually checked the box on his application for a driver's license to register him as a voter so he didn't do it himself. His attorney said, you better go down there and get that erased because that could become a stumbling block when you do in fact become eligible to apply for citizenship.

So this was, I was just at an event last evening where this fellow was sharing this with me, that that becomes problematic. So you know, this is a big deal because these turn into votes someplace, somewhere along the line and the states allow these people to get driver's licenses. They allow them to legally drive and if they're doing so, and the argument of course is if they get driver's licenses then I have to get insurance, et cetera, et cetera, which may or may not have some validity but the problem is they register to vote and even if they don't register to vote, there's nothing to prevent somebody in authority in the check in the box, check the box to register them. So this is a huge problem, you know, and apparently we're going to have only a couple of minutes left and I had a situation myself regarding election matters, regarding Georgia and where they were trying to have a fellow come and testify in this trumped up if you will, investigation, trying to muddy up President Trump for the coming 2024 election saying that he meddled in the Georgia elections in 2020 based on that infamous phone call with Brad Raffensperger where he says, can't you find 11,780 votes, which is just hyperbole and so there was nothing criminal or nothing untoward about that phone call. People were still processing things in Georgia and so they were having that issue and Georgia is trying to say that Trump was acting illegally with that phone call and so they've been going and having this, trying to have this parade of witnesses that are only tangentially collected to that and for what it's worth, I think we'll talk about it in detail next week, my guy that they tried to bring from Illinois to Georgia to testify before this body, which they loosely call, which they call in Georgia a grand jury, which under the history of grand juries, they are not a grand jury because a grand jury can always indict someone.

They can start a criminal process and indict somebody and this entity in Georgia has no authority to do so and the guys here, the case here that I've actually handled, Georgia did not obey Illinois law when it was trying to bring Reverend Stephen Lee from suburban Chicago to Georgia to testify in this trumped up investigation and that all revolves around 2024 and what of course President Trump did last night. So there's a lot of things, there's a lot of moving parts everywhere that are doing this, but these are real, real problems in terms of, and in the end, Greg, it always does come down to elections. It always comes down to elections. It's like you were talking about the Texas primaries. This of course is now going on with what habits reelection would have been really great if information like this was circulating prior to the primary election.

So Texas voters would have had the opportunity to make an appropriate judgment when it came to nominating their candidate for governor. Well, and again, we'll cover some of this kind of stuff in our section with Michael Morris and MRC. This is what News Busters tries to cover is how news media and bias and you know, Dr. Robert Epstein talked about this kind of stuff as well with regards to the Google bias and he suggested that, you know, that there would probably be anywhere between six and 20 million people that would be affected in this election cycle that just happened predicated on Google's manipulation of searches. Well, if I would, I sent you a couple of links to some of the stories about my case. I sent those to you yesterday.

Maybe you can share those to set us up for next week. And on the bright side of all that, there's a story of my involvement and one of which comes from CNN and I would have to give credit where credit is due. CNN quoted me perfectly.

I was shocked. I will tell you that I got four calls from the New York Times and two emails from them and I did not talk to the New York Times because I didn't trust them to write the story. But CNN quoted me exactly and properly and in context. Well, I tell you what we will do is we will get this article up. I guess we'll get it up today. Georgia prosecutors investigating Trump's efforts to overturn 2020 election lose subpoena fight with Illinois pastor.

And that's a CNN article, one of the very few CNN articles that I'll probably ever put up. Nonetheless, we'll get that up very quickly in closing your thoughts with regards to some of these close elections, especially in Arizona and the Kerry Lake election. And are we going to see, you know, recounts and what is your anticipation with regards to the possible battle relative to some of the election outcomes that we've seen?

I've got meetings on Thursday with three different candidates myself here in Illinois. We have an interesting anomaly that one countywide candidate got more votes than the corresponding candidate for governor in their county. And this one candidate for county treasurer got more votes than JB Pritzker who won the governor's race going away.

That just doesn't happen where down ballot candidates get more votes than the top of the ballot. In this situation, this was JB Pritzker and these are huge problems all over. You can expect plenty of litigation, plenty of worthwhile litigation in these cases.

What can happen? We will, time will tell Greg, but yeah, there'll be a litigation in Georgia. I'm sure I, or excuse me, in Arizona, in Nevada. Yeah. Well, and there's ongoing litigation in Pennsylvania as well. Although there's a problem there because both Memet Oz and Mastriano have dropped.
