And now, of course, you know, it's back out again and new information and now Stroke has a potentially direct tie via working as an undercover CIA agent operative under the auspices of the FBI. So that the CIA could spy on Americans on American soil.

Yeah. Why not? Let's just do everything illegal. Oh, and let's do it, by the way, while the other party's president is the president. While the other party has a president in office so we can make absolutely certain that we're committing treason.

And that's what it is. It's treason. And to talk about some of the treason side in the Constitution and things of that nature. It's always a pleasure to have with me on Wednesdays, David Chistokas, constitutional originalist. He is the author also of a couple of great books. One of those being constitutional sound bites. It's great to be with you. It's always a highlight of the middle of the week for for me. You know, we look forward to it. And then we know that the weekend is coming up after that.

Actually, now we're getting closer and closer to Labor Day. Yeah, the weather's getting cool. And so I'm getting ready for hockey. Black Hawks here. We had occasion to mention Bobby Hall, you know, there was a variety of folks that I actually grew up with, who were on the 1961 Stanley Cup winners, Bobby Hall, Erik Nestor, Renko, Pierre Palad, Glenn Hall. So but young fell then by the name of Chico Mackie, I was, we used to go to those games.

One of those games during that during that run to the 61 come, went into triple overtime. And I was only eight years old. And it was so cool to stay.

Like three or three in the morning, you know, awesome. How awesome. Well, and back in the day, it was a it was a whole different city back then, too. It was all absolutely this. Of course, the old Chicago Stadium was on the west side of the city has now been replaced by what they call the United Center. But the old Chicago Stadium was on the west side of the city perfectly in those days, perfectly safe, no problems going to the west side, west side of town to the Chicago Stadium at eight years old with your dad and everything like that to the hockey games.

Strangely enough, even we were there. So this was so long ago that they didn't have glass around the rink. They had actually chicken wire. Oh, my gosh.

And they cut holes in the chicken wire for the TV cameras. Ah, that's crazy, huh? Why are going of course, everybody knows how expensive professional sports is these days, right? I was I was a Cub Scout when we were going to those games. And my dad, we were season ticket holders, but my dad called the call the Blackhawks and said, asked if he could get a deal to bring my Cub Scout troop. They gave him literally gave him 50 tickets. Wow.

For all the all the Cub Scouts and their and their and their parents to come to a hockey game. So it's a different world, Greg, you know, it really was. That's so cool. I was telling you I was a Golden State Seals fan back in the day and my next door neighbor's sister who was about 30 years older than us, worked for the Oakland Coliseum. And so she and and they she and her husband had bought a house at the other end of the street that we lived on.

And but she would come down and bring some of the guys down and I got to meet Carol Vagnier. And we had one of those, you know, back in those days, it was really a big deal in California to have a screened in room in the back. So you had indoor outdoor carpeting on on what used to be your patio. And then you had this indoor outdoor screen room with with the little plastic panels. And and during the fall, and the spring, you would take the panels out. So it would have this kind of open air feel to it. And then during the winter, you would close it all up.

Like we had a winter in California. I know. I know. I know. I know. I was I was prepared.

I was prepared for that. But at any rate, we used to be in that back room and play indoor hockey in that back room. And so we couple we got to get Carol Vagnier out on our on our pretend ice. There was also something very special about that whole thing in California and that would be ice.

Yes, yes, absolutely. But yeah, no, she brought them and also she brought some Oakland Athletics home to Chuck Dobson, who pitched the first no hitter in Oakland for the A's back in the late 60s. Also was there. And then of course, I, you know, met Dick Green through my mom and, and she was a worked in a medical office in Hayward and his wife brought the kids in there.

We got to be pretty good friends with the greens. And I used to I got to go to A's games and I actually got to go to the A's World Series games in 72 73 and 74. And we even sat in Dick Green's box. Amazing, amazing teams in those days, Raleigh's fingers and the mustache. Reggie Jackson, Sal Bando, Campi Campinaris, Bill North, I didn't realize I actually was watching the, I think it was the Baltimore Orioles and the and the Cincinnati Reds. And I didn't realize what a what a great player Don Mincher was. I he was just kind of an aside because he was only there for one year for the A's run. But he played in a couple of different World Series in his in his younger days. So I just thought that was kind of a kind of interesting, but I've been I've been feeling nostalgic based on all the nonsense that's going on, David, I got to tell you, I try to get it trying to get a little bit of relief.

I, I watched the 1952 World Series last night. Oh, my goodness. Yeah. Yeah. Oh, my goodness. Yeah.

1956 and Don Larson's person. The game. Yeah. Yeah, the perfect game. But it was still that was still, you know, the Brooklyn Dodgers and the New York Yankees in 52. Yes.

So that was and that was and then and then I watched the 61, which was Mantle and Maris. The movie? No, no, but the actual games. Okay.

Yeah. Some of the actual games and the highlights from the 61 season. Yeah, the movie 61 is really very good, too. You know, it's excellent.

It's an exciting time. And unfortunately, over time, Roger Maris did not get get his due, you know. No, not not until not until 1992, when they finally took the Asterix away. You know, which was which is Yeah, which is really quite sad. All right.

I want to get to to a question that I had asked. So, folks, pardon us as we've wandered down nostalgia way. I hope you've enjoyed that conversation a little bit. And that is having to do with on the local level. I had mentioned to you that, you know, that I wondered about folks going and talking to their local county judges and their local sheriffs about some of the intrusions by the by federal authorities. And and so the question that I have is, you know, what level of authority does the local sheriff have and under what and under what legal precedent?

So let's I guess let's start with that one. Yeah, certainly among your among the questions that you were posing in that that you're interested in them and talking about is to what extent does do local law enforcement authorities have the ability to enforce the law when when the federal government comes in their jurisdiction and essentially acts illegally? For all practical purposes, right? If the if the if the agents of the federal government are trying to execute a say execute a warrant that was not obtained properly, or come into the jurisdiction and exercise local law enforcement authority without having talked to the talk to the sheriff without having an exit, you know, established cooperation in that regard.

And it's very strange. You know, there's something interesting about the Constitution generally, when we while we in fact, ultimately look to the Supreme Court to give their opinion on the situation regarding the Constitution. In some respects, every every government officer has a duty to in fact, obey the Constitution, to the extent that they have the ability to within the authority of their jurisdiction, they have the they have the ability to make their constitutional interpretation until it gets otherwise decided by a court. And so in those in these circumstances, should a federal officer come to execute a search warrant without having provided knowledge to a local authority, and without doing the all the things necessary to get that proper, they would should be subject to arrest like any other citizen that invades somebody's home. This is this is what's at issue in the in President Trump's President Trump's motion on the Fourth Amendment to appoint a special master to review what the what the FBI agents walked out of Mar-a-Lago with.

Because and this is that's it. And we're going to get to that. But the the county the county authorities, in fact, have have authority to in fact, interdict federal officers, if the county authority believes that the federal officers are acting outside the law. All right, we're going to take a quick break, we're going to really get into this, folks, when we get back. So please stay tuned, tell your friends, by the way, as well, look, we the people are what's going to stop this, this usurping of authority. We're the only ones that can do it. But we have to have an understanding of the facts so that we can present them and we need to be able to support our local county judges and our local county sheriffs by helping them to understand these facts as well.

At any rate, we're talking about, you know, the things at the local level, which takes us into the Fourth Amendment issues, which really takes us into the case of our 45th president, Donald John Trump, and what happened to him at his residence in Marlago, which was federal agents serving a warrant and going into his home and and many are questioning where was the local authorities? Where was the local sheriff?

Where was the local law enforcement? And now with all the questions that are coming to bear about the judge and his background and who he is. And and now we're going to get into this with Sam at the top of the next hour. But questions about Peter Stroik and his involvement in this John Brennan, the the the entire FBI crew that carried this out appears to be the same crew that was carrying out all of the Russia, Russia, Russia FBI investigation that we know was bogus. All of the phony FISA warrants that were sworn out based on illegal documentation. And somebody should be going to jail for all that.

And now that same crew apparently went into Marlago looking for the evidence that the president had declassified that proved they were all criminals. That I mean, you know, people want to talk about Watergate and all this other kind of nonsense. Let me tell you something, folks. We've I mean, right.

The Russia, Russia, Russia continues on. At any rate, I've prefaced as much as I think I can from a non attorney perspective. David, jump in here and and let's talk through this. And we're going to spend probably the whole next half hour talking about this.

Yeah, sure. And the issue really turns out to be the Fourth Amendment. There's an interesting problem with the Fourth Amendment in terms of how it is executed here and here in the country, how it's enforced here in the country, because the Fourth Amendment is that amendment that grows out of the king's writs of assistance.

You always have to look back to where these things came from. And there was the writs of assistance during the colonial days that allowed the king's agents to essentially search anywhere, anytime for a period. Once they had one of these kings warrants in their hand, they could search anywhere, anytime for up to up to until after six months after the king died and there was a new king.

So these things lasted forever. And that's where we wound up with the Fourth Amendment regarding protections against what they call unreasonable searches and seizures. And of course, arrests that require a warrant to do these things, that requires a sworn statement by a law enforcement official presented to a neutral magistrate describing with particularity the items to be seized and the places to be searched. And so that's to some degree is what is at issue in the Trump matter. And it would also be at issue in some sort of hypothetical that you were describing to your sheriff and judge, because it's the particularity issue, one of which, one of the particular particularity matters. And that's actually in the amendment particularity. And so because the amendment or because the warrant itself said things that were stored with other things that they were looking for. So they could just willy nilly take a look and there's always like this blanket warrant. And usually, Fourth Amendment litigation turns out to be something that happens after a criminal case is underway. And that is when a defendant in a criminal case challenges whether or not the evidence was acquired in a fashion that was legal, and whether or not that evidence should be suppressed in the in the trial of a of a criminal charge. And that's a that's a failing of the American system and how that's enforced. And the president is bringing number one that to life because he has not been charged with anything criminally. Or, or, or so we believe he hasn't been charged with anything.

It's almost like they've attempted to slip that in and infer that now, you know, there's there are criminal because I've seen some headlines from some of the radical fake news. And welcome back to chosen generation radio where no topic is off limits and everything filtered through biblical glasses. The right of the people to be secure in their persons, houses, papers and effects against unreasonable searches and seizures shall not be violated. And no warrants shall issue but upon probable cause supported by oath or affirmation and particularly describing the place to be searched and the persons or things to be seized.

David. Yes, this of course is part of the problem with the Trump warrant right at the moment. And that warrant talked about not only boxes with particular information that they were looking for, but warrants and any other things that are in the vicinity of the things that they're looking for.

And generally around the whole entire place. So they didn't do anything, there was no description with particularity or particularly describing the things to be seized. It was a blanket if you will, you hate to use the term, but fishing expedition.

We hate to diminish fishermen that way. But the fact is that's what they were doing. They were going around and they took a lot of property that is likely not even remotely related to the matters at hand regarding the alleged classified documents that they're supposedly looking for. And of course, the whole issue about them, they're being classified, of course, is moot because Mr. Trump had the ability to declassify when he was president, before he left, before any documents and traveled with him and otherwise. And he's presented that evidence, by the way, to the American people in the form of photos and documents that he has revealed and shown where he in fact declassified these documents.

Yeah, so the whole classification thing is a shibboleth, so it's just not worth that. That doesn't even give probable cause, which is something that is interesting that needs to be brought to the attention of Judge Reinhardt. But this is a very, very important case that the president is making in this matter. And that important case is that should he be successful in going forward and having this material reviewed outside of the purview of the FBI, this can create an important precedent for all Americans.

Mr. Trump would be benefiting every American because as we were talking about earlier in the first segment, the typical manner in which the Fourth Amendment is enforced is after criminal charges have been filed. And then if something was obtained illegally, let's say a warrant was issued because of a false probable cause affidavit. And while we're off the air, we're talking about the whole FISA series of warrants that were issued based upon essentially lies. And those FISA warrants should not have ever been issued because the probable cause affidavits contain lies. We don't know what's contained in this probable cause affidavit, but the ability for citizens to challenge these warrants before they are criminally charged would be a huge step forward in enforcing the Fourth Amendment in American law. There's something missing in the process because usually right now, again, they issue a warrant, they see some stuff, and then you go to court and the lawyers for the defendant that have now been charged, then they get to argue that the items were seized illegally. Whether the affidavit was inadequate or the officer that presented the affidavit presented erroneous or even false information.

And so then the issue is whether or not that it can be admitted in the criminal prosecution. But if you can challenge these things before there's ever any criminal prosecution, citizens will be much better off in terms of running a challenge at that point. And this is an important service that the president is providing to Americans generally in terms of protecting them from federal overreach. That they should have the ability to go to court before they're charged with anything.

That hasn't existed up to now. And so this could be a very, very important case. I saw President Trump said there was going to be a major Fourth Amendment motion, a major Fourth Amendment case coming out of this. And I saw some of the commentary and of course Twitterverse and elsewhere that had gone, what kind of major Fourth Amendment case? It's big.

It is big. It could have huge impact for all Americans everywhere, particularly in light of the 87,000 new IRS agents. Absolutely.

You want to keep out of your house. And the IRS agents should be civil enforcement, but not criminal. But they will be looking to enforce criminal law as well.

And so we need protections under the Fourth Amendment in advance of having been charged with a criminal violation. Well, and of course, you get into that, the amount of training that is going to be brought forward as it relates to those agents appears to be almost non-existent. They're going to be immediately throwing them out into the field. We broke the story here on, well, the story was broken actually by current revolts, but current revolts, Tony Ortiz was with us on Monday talking about 25 offices. Of the 50 offices that they've opened for hiring, David, 25 of them are right here in Texas. And they have eliminated the normal process they would go through for screening of employees by using what they're calling emergency direct hire components. So that means that a lot of the background checks that they normally would do, they're not going to be doing. They don't have to try and find veterans.

They don't have to adhere to any of those kinds of things. They can bring these people on. And some people on the inside have inferred that they are going to be hiring here in Texas a lot of Antifa.

I don't know what their labor pool is, but perhaps I'll go down and apply. Well, come on down. Yeah, I mean, it's really, you know, but to your point, you know, this is significant.

The first thing that I thought of was, oh my, you know, but here's the problem. And this is what our founders said. And this is why we talk a lot here at Children's Generation Radio about, you know, the moral aspect of these things. And that is because good laws are only good because of the actions of good people. So in the same way that these Fourth Amendment laws and these procedures will defend good people from being unfairly prosecuted.

You can be certain that criminal elements will use these same benefits in an attempt to be able to shield and screen themselves from being caught. Well, of course, there's a general philosophy, however, that better than 99 guilty individuals go free than one innocent person be locked up. And I think that's really, really important.

I think that probably overstates the case. So we don't want to lock up a single innocent individual, and we should bend over backwards to see to it that that does not happen. And where you start with that is you start by changing the moral function and the moral base and the virtue of your populace.

And that's why I mean, our entire system, unlike, you know, authoritarian and dictatorial systems and communist systems and so forth, our entire system is built around the idea of defending and protecting everyone's liberties, rights, freedoms, it's all about freedom. And but without a virtuous moral base, then you end up having bad actors, you know, as an employer, my employee handbook only existed because of the fact that I had I had at times bad employees, I had employees that were not there for the right reasons. So I had to have a book of rules so that those people wouldn't take advantage of me and collect a paycheck from me and and mess up my business. You know, that's a great analogy, Greg, to call the Constitution employer hand employee handbook for us to us to control our employees, i.e. the government and the government people, in fact, are our employees. And it's an employee handbook that is supposed to keep them in charge and define the rules of conduct for our employees.

The folks who work for the government and consequently for us. That's a wonderful, wonderful analogy. I've never heard that before, you know, to create that analogy between the Constitution and employee handbook. But that's that's precisely what it is. And it goes on the assumption, in fact, that there are bad apples within that within our within our within our society, within humanity. And then real quick, we're going to take a break and then we'll come back and talk about this some more.

But then that also changes. You've got to think about now. We, the people are the bosses. We, the people are the bosses. So if you're an owner, you know, initially it's like, oh, I'm an owner, I'm going to take advantage of this and that and the other. But you begin to understand that as an owner, you have all of the responsibility and you better act accordingly.

We've got a whole lot more coming up, two more great hours. But we're talking about and we were talking about as we were going in this fourth amendment issue and then we were also talking about, you know, why it's so important that we have that the virtue and we compared it to the employee handbook. The Constitution as a handbook for who our employees and who are our employees again, we the people and man, we just I think that's another piece that I think is so important about this case that President Trump is involved in and I'm glad that it's highlighting. Because, you know, this is, I mean, January 6, little boy Finneca murder, the Bundy ranch situation, the Waco situation, the Ruby Ridge situation, we started with Ruby Ridge and telling us that we're not sovereign citizens. It really started there. It started by telling us that we're not sovereign. We're not in charge.

Bow down and kiss the ring. That's how it started. Yeah, well, it's a little by little. And, you know, there's a lot of history to a lot of things. And I we could do the 17th Amendment.

Oh, yes. And the 17th Amendment is a huge problem. But yeah, but but this is what the President is doing here is, is, as I mentioned, extraordinarily has the potential to be extraordinarily important for every American citizen in terms of protecting themselves from governmental government illegal government action. And then that brings us right back to our initial conversation, which is about how you can interact with your local authorities, your local sheriff, your local county judge. And, you know, and and and it is absolutely reasonable for them to say to you, listen, give me something that I can work with. And and I'm and I'm right there with you.

But I need something that I have in my hand that I can say when they come knocking at the door. No, no further. You can't come here and do that. And there's the interaction. Of course, we have the restrictions of the Fourth Amendment on the government. But in terms of enforcing those restrictions, there's been a patchwork of things put together over time.

And the strongest one that turns out to be what they call the exclusionary rule that says that things that are evidence acquired by the government in violation of the Fourth Amendment is not something that can be used in the prosecution of a case in the prosecution of a criminal matter. But that's after the fact, though, that's after the fact. Right. That would be after they've already kicked your door down and tore up your house and grabbed whatever they wanted to grab. And now you've got to go hire an attorney. And if you don't have $10,000, right, or $100,000 to plunk down as the retainer, if you will, now you're just at the mercy of whoever at the judge that gave this Fourth Amendment, that gave him the ability to bust down your door and come into your house. And in that instance, for him to reverse his decision means to incriminate himself and to suggest that he shouldn't be given that Fourth Amendment warrant to begin with.

That's it. That's exactly the case. And that is why a process of in advance notifying local authorities and showing the local authorities what they're going to be up to prior to being involved would be an additional check on the execution of the Fourth Amendment to say, have your sheriff review what they're going to do and see if that, in his opinion, complies with the Fourth Amendment, pursuant to, in fact, the Tenth Amendment, because the Tenth Amendment reserving the powers to the states, the local authority, ultimately means that the local authority are the ones that are granted police power. You know, the federal government was never granted any kind of police power to begin with, generally speaking. And so, you know, in that regard, if they're going to execute federal law, the supremacy clause notwithstanding, because the supremacy clause, generally speaking, is in regards to conflict of law between the states and the federal government.

That doesn't mean they're supreme in every walk of life. They're only supreme within those authorities given by the Constitution, primarily in Article I, Section 8. And if they're trying to execute something outside of that, then the local authority has the ability to overrule them.

And just because they have a warrant, if the warrant was issued itself illegally, they are no worse than any common criminal invading your home, or they're no better. And the challenge for the local authority becomes, how do I know, based on what I get, if I don't get, you know, a larger pool or a bigger picture, if all they hand me is the document that says, here, I have a right to go into this person's place, and they don't give me other stuff. They, including the probable cause affidavit. Exactly. Exactly. Exactly. So the sheriff and the local magistrates need to say, no, I need to see the rest of the documentation so that I can support what you're doing.

So that our guys don't get in a tiff with your guys. Exactly. And so if you're not going to provide me with that, so that really, that's what it boils down to is, is they need to present to the local magistrate, the local authorities, all of the documentation that supports probable cause and their reasoning for why they have gotten this warrant. And then the local authority needs to look at that documentation and they do have the right to make a decision. And I guess we need to give those local authorities, if there's case law that supports that they have that right to refuse to say, no, I think this is illegal.

Maybe that's the kind of material we need to give them so they can feel comfortable to do that. So they can feel comfortable to protect the citizens that have elected them. Absolutely. And that we are not overrun by the federal bureaucrats.

Right. And actually ultimately have the protections of the local authorities. And of course, that's the whole principle of the United States to begin with is that local control over matters is the best control. The people that are closest to the people, the government officials closest to the people are the ones best situated to make these kinds of decisions.

Amen. So, you know, they have an additional process that would involve those folks. The feds don't like that stuff, you know. The feds don't like anybody.

They want to rely on the supremacy clause and ignore the 10th amendment. Yep. All right. This is a problem. We're going to jump. I know you've got to go.

Right after this. These are domestic terrorists. The six was all deception. The level of sophistication.

Hactic. People were putting on Trump stuff beforehand or taking it off afterward. It was members of our own government.

More has been an FBI informant for a number of years. In January six, I said, are you working? He said, yes, this is treason. They want to criminalize dissent. I open the shutters that had the battering ram. So I hear, then they told me to come out, hold on to red dots all over my chest. They're hunting down Trump supporters like dogs.

I just walked into a crowd of people. I spent the next three weeks in jail. They put me in a cell by myself. Total solitary confinement in a cell not much bigger than a walk in closet. FBI guns drawn.

Hands up, hands up, hands up. Put your hands on the wall. This is psychological warfare.

It didn't have a battering ram in it, but what it did have was a turret on top. He was pointing his gun at all my neighbors, ready to pull up anytime he needed to. They handcuffed you. They handcuffed you?
