Breaking news pixel venue course extends the mail in ballot deadline three days after election day. Talk about that more today on Jay Sekulow live live from Washington DC. Phone lines are open for your questions right now: one 806 843-110-1800 68412 your holes Jordan secular supreme a lot of people to mail in voting differed from absentee ballots. Absentee ballots in most states should be your duty to request now, or should have already requested and then you'll receive in the Postal Service saying you get those out as quickly as possible, less bipartisan by the way both parties are saying that your ballot may treat if you don't absentee follow the rules. I will tell you this to is someone who is been involved a lot of campaigns in his had to vote absentee twice before on the Presidential elections. Not all of them. I voted, but a couple times. You really do have to look at the rules in your state me what color ink. What needs to be signed.

If you mark there sometimes withers like a road. If you mark like two boxes in that row.

That's it. It's your ballot has been tossed.

If you make any errors so you have those issues that you want to take seriously thought so for those you are doing absentee voting in the rules are different.

Every state but the sooner the better their Pennsylvania's court, though, has come out with an opinion the states. The state's highest court that is extended. The states mail ballot deadline. This means when your ballot has to be stamped by the Postal Service, not by just you but you when does it go through the Postal Service until November 6 of this year.

That's three days after the election at 5 PM so in effect has extended election day for three more days three additional base that it could go through the post. It has been postmarked.

Here's what's key is that so what date you marked on it. That's what date the Postal Service marks on it and he also put in this appeal if it is like they can't read it.

I assume it met the deadline. So, on top of extending the voting day, three days they have also included a provision that says if it's illegible the postmark is illegible that they can't be figured out.

Is it is a test three is an eight units that you know what, what is the date here, they'll assume it's it meets the deadline. So again, expanding the potential for fraud and were sitting across the country. Again there are windows I would make this clear for those who serve overseas. Our men and women who serve overseas.

There are special exceptions for them and their ballots. Often times, most of the time these ballots are not counted on election day. They do a basically S a total of how many ballots do we have what was the outcome in our state.

Could they possibly change the outcome of of our electoral votes and would those outcome of those electoral votes impact who was President of the United States.

Obviously they can impact lots state races in local races so they do get counted, but as you can imagine they do not argue counted necessarily on election day, in every state. In some states they have to because the margins are always so close so that they're going to do the soup in Pennsylvania.

That means what I'm assuming is a big state big population that there could be so many outstanding possible legal ballots that they can't really tell us much about the election results until after Friday at 5 o'clock because it could be enough votes outstanding easily in a state the size of Pennsylvania that would change not just local elections or congressional races or house races or Senate US and the rates gubernatorial races but it could change the outcome of the electoral college and who gets the electoral votes she could have again you are setting up a delayed election in swing states. It states, you know are key. Pennsylvania is one Donald Trump flipped if he does it again.

That's huge for a Republican candidate almost signifies on election night, which I think is also what they wanted. They're trying to do if you win Pennsylvania on election night. That comes in fairly early Easter East Coast. They don't want you to be able to win Pennsylvania on election night. They don't want that narrative going out while people might still be in line in places like on the West Coast in Arizona will take your calls 164 3110 Rick Grenell also brought challenges facing Americans is a time when our value or freedom sword constitutional rights are under attack more important than ever to stay with the American Center for Law and Justice for decades ACLJ has been on the frontlines protecting your freedoms defending your rights and courts in Congress and in the public arena and we have an exceptional track record of success. But here's the bottom line we could not do our work without your support, we remain committed to protecting your religious and constitutional freedoms event remains our top priority, especially now during these challenging times.

The American Center for Law and Justice is on your side, you're already a member. Thank you, are not well this is the perfect time to stand with us. ACLJ.org where you can learn more about her life changing, member today ACLJ only one. A society can agree that the most vulnerable invoice.

Is there any hope for that culture to survive. And that's exactly what you are saying when you stand with the American Center for Law and Justice, defendant the right to life, we've created a free powerful publication offering a panoramic view of the ACLJ's battle for the unborn, called edition like it will show you how you are personally publication includes a look at all major ACLJ pro-life casings were fighting for the rights of pro-life activist ramifications 40 years later, their role in the Obama care means to discover the many ways your membership is empowering the right question for copy mission life today online ACLJ/rethink your phone calls.

In this way hundred 64 3110 also record now ACLJ special advisor for national security and foreign policy of former acting director of national intelligence and US ambassador to Germany be joining us in the second half are the broadcast by the weight you will take your phone calls as well. We got into some deep discussions is like going on but you could also ask questions for him that you have a question for him. Let our call screeners know that it and so we can note that for you not take your call before and also keep you on but he's got a new piece up it's up now it ACLJ.org is called present Trump's style is working and why that's infuriating. Washington DC and infuriating the left. That is by record. Now it's up@aclj.org will talk about his new piece as well.

When he joins us in the second half hour of the broadcast to have a Pennsylvania court now this is Pennsylvania has been the top swing state for as long as I've been involved in politics and campaigns, but it is been estate the Republicans could not flip they would spend a lot of money there.

It was worth it for both sides had to campaign heavily there in Pennsylvania, which some people see is how can it even be possibly Republican.

You do have your course you got your Philadelphia and Pittsburgh kind of hotbeds of where the left against their votes, but the rest the state. We can call the T of the state in Pennsylvania so you go up and then cut of East and West very conservative. It looks it looks much more like the Midwest looks much more like not like what you think of Philadelphia Pittsburgh with where you got like it Philadelphia course heavy heavy African-American vote that's been strongly Democratic, and you got that and in a big labor vote in Pittsburgh a huge labor vote so hot. It had a Republican slip that well you got appeal. Those labor voters.

Some of his African-American vote. Donald Trump was the kind of candidate that did that and so when he took that from Democrats on election night. You could basically call the election right that it was over for Hillary Clinton when he took a Pennsylvania now what they figured out as a way and this was a lawsuit brought by the Democrat party of Pennsylvania, so this is partisan, they extended not this such as absentee ballots either mail ballots they've Artie got that going there but the mail in ballots is either postmarked three days after the election. Three days after the election are like today's November sale received after the election night back to me, postmarked they can be the place. What's with Mark the day of that, the guy received by 8 PM but received out yet so perceived that means when they actually got the Postal Service actually got them yet.

When next he got to the board of elections and you're talking again folks three days.

What will that mean on election night and extended yet drop offs, they have to deliver those. I take it the day of the election, but it just creates and creates the idea that one will not get results in a critical state and you won't have that kind early momentum that each campaign is looking for.

By the way, what does that tell you about campaigns wears a tape over the Democrat party things Pennsylvania is going by the way they think elite. They got extend all these deadlines is much as possible.

So where there they can be postmarked on election day, but not actually received was I don't even totally understand what process, what are they so concerned about that if they put the boxes out to take in the ballots.

Why are they ready to pick up the boxes on election day.

You know by APL 8 PM election whenever the polls close exactly. That night, but we know those votes don't usually get counted that day when there's something else that you said that's that earlier about the not clear on the dates and this is what you were talking about. The court also wrote this, the court wrote the legislative decision is not what the equipment is required under the law, the court wrote that ballots received within this.

That lack a postmark or other proof of mailing or for which the postmark or other proof of mailing is illegible will be presumed to have been mailed by election day, unless a preponderance of the evidence and he demonstrates that it was mailed after election days met with sharp Republicans to come in and challenge the presumption by presenting the evidence. How are you going to be able to make to come to the conclusion that the ballot was mailed by election day. What is the proof that you would use in court to prove that there is no way that you can do that you have to go back to that person and you would have to examine that person depose that person under oath and make a determination on each person on an individual basis. They want election chaos. Yet what they don't they don't want us.so if they can get this a few other states where you basically their dues are large enough states where you could imagine a scenario where Donald Trump is waiting but there are so many of these outstanding male in whatever you want to call these ballots that it you don't like Donald Trump or not. You can't make the call is not right to do because under these new rules way too many outstanding potential votes that they could have the potential to flip not just local races but the electoral where the electoral votes go and that means you Pennsylvania caught on election night very tough to call the entire election.

Well, it's so many electoral votes and we probably could yet been set for either candidate to get to set, so here's the great conflict and thing I know this is something that's going on in the kind of washing and thought processes you could have a situation toward where you have dueling electors where it's too close to call the Secretary of State can certify you got a Republican slave in the Democratic site. They say you know what just turn over to the legislature Pennsylvania controlled by the Democrats and let them decide and that plan can become then you could ultimately distinction go to the House of Representatives Congress absolutely Tapping twice before United States history could happen logon with Jordan on the outcome in Pennsylvania not being able to be determined on election night. If these are the rules exist, it's good to be so close and I think the other thing here J. Jordan mentioned Arizona if Donald Trump does win Pennsylvania in the Democrats will be desperate to keep it before being called from him before Arizona closes because that's another swing state, but after all of that dust settles the thing to me that bothers me the most about this Jake is actually something that the majority wrote in this opinion. They said the legislature enacted an extremely condensed timeline in the court didn't like that.

Guess what, so what, that's the legislature job and it doesn't really matter what the court thinks about that because it is the legislators job.

Legislature's job to do to enact that timeline to me.

J they gave away the game when they wrote that the legislator enacted it, it should stand Pennsylvania has 7.4% of the electoral votes you need to win the present selection almost 10%.

They picked at 5:30 AM at the Wagner Nate Silver, Pennsylvania. The most important state in 2020. Okay so they come together in the Democrat party file this lawsuit, not eight outside voting group literally to the Democrat party Pennsylvania so they pick the most legible support letup to states in Pennsylvania has a lot of fans that it can come in late, but early enough to where it starts impacting the West so Arizona so they and the intentionally pick Pennsylvania as the state to launch this post postmark date balloting alerts ballots received after the election date which will allow for the military because there's a reason there foreign military bases, but not for people that live in Pennsylvania, met with the law said, but they could intentionally pick that because Pennsylvania not only as a key state is going set for electoral votes, but a early call on that or no call on that could affect states like Arizona, Colorado, that are coming in later the bonds as well. Yeah, it was obviously a target by the Democratic Party to see if they could swing the election by calling a state or not calling a stater creating chaos in a state which is what's gonna happen in Pennsylvania I predict is going to be the chaos in Pennsylvania that we saw in Florida during the Bush show situation. This is not a lot we have an election day in the United States. We don't have an election week in the United States and that's what this is become J and Jordan. This is become election week come one come all file your balance whenever you want to and then come back and then pried up for someone who challenge the ballot to prove that it was not filed on election day because the Supreme Court on its own has made a presumption that unless you can show by a preponderance of the evidence, we will presume that it was filed by 5 o'clock on the day of the election you make that presumption can you prove that evidently you look at the electoral College by state. It is only a handful of states like Pennsylvania, which have 20+ electoral college votes, Pennsylvania and Illinois, Florida, Texas, California, New York. Okay, so now we know New York and California toss of the site is going Democrat he could put that in the divine, likely though some people talk about New York potentially flipping, and there's been so many so much change in where people live, there's been questions about that. To this, but such migrations that have happened because of covert restrictions also migrates that happened because other writing this that maybe you don't just traverse the Democrat column but then any Pennsylvania you know even real. Romney lost Pennsylvania by 1.2% George W. Bush lost by 2.1% tightly. Oh, I Trump carried by 2.5 it's going to be very close. There, but it's usually close if we can call it in that kind of ink and can in the night on election night, I think, look, this is the date they picked that their unit given a target benefit hundred 50 states target segments extend any Pennsylvania may be Ohio. It's already been Wisconsin and Minnesota.

It will be something in Arizona. There will be something in Nevada. There will be a big issue in Florida. Mark my words reckless and happier and just to make sure that they don't steal the election the day after the election right as I think the real fight on this, despite now the real fights could be November 4 record out record our special advisor four 24 policies joining us know after this breaks a good question for Rick getting a call that 100-684-3110 letter call screener know that as well. You will be joining us. The next segment of the broadcast got a new piece up@aclj.org. Present Trump style is working on that upsets Washington DC will be our back on Jay Sekulow life. Only one. A society can agree that the most vulnerable invoice is, is there any hope for that culture to survive. And that's exactly what you are saying when you stand with the American Center for Law and Justice, defendant the right to life. We've created a free and powerful publication offering a panoramic view of the ACLJ's battle for the unborn Gold edition like to show you how you are personally publication includes a look at all major ACLJ cases were fighting for the rights of pro-life activist ramifications 40 years later, when Obama care means to the pro-life in many ways your membership is empowering the right question for copy mission life today online ACLJ/challenges facing Americans as time went on freedom's or constitutional rights are under attack more important than ever to stand with the American Center for Law and Justice for decades ACLJ has been on the frontlines protecting your freedoms and rights in courts in Congress and in the public arena and we have an exceptional track record of success. The American Center for Law and Justice is on your side, you're already a member. Thank you, are not well this is the perfect time to stand with us. ACLJ.org where you can learn more about her life changing, member today ACLJ Jay Sekulow this Jordan secular articular phone calls 100 684 31 to our special advisor Rick Grenell's been on the road a lot of the past few weeks he he is special visor frosted national security and foreign policy had a new piece up ACLJ.org I'll tweet that right after the broadcast present Trump style is working. We talk about the sum earlier in the week with Rick that just the style of leadership. The piece deals with those go by the way, say what happens with lesson we just talked to Rick even how much happened, but it was also Rick's happy birthday to Rick and you look like you're on the road again. Which is kind of your life right now. Every time I see the President.

He says you are traveling and you're on the road right yet why would I got the same, but I was there. This couple days ago for meetings with the President and was the same kind of thing, but mostly mice focusing on cases not not so much the campaign, but would you race something and I I said this to the President is no secret that his style and you really do a great job of laying this out is so different than what Washington is been used in many see the success with the Middle East ring literally restructured before our eyes. I mean completely restructured before our eyes.

It's not a Washington style of leadership. It's a businessman style of leaders very transactional in that regard, but you think that's the way reason of the successes happening.

Yeah, you know, there's so many people that I hear all the time in Washington that will complain about present Trump style or say that they don't like it and I always take the bait.

Whenever I hear that I say will okay let let's talk about the style and I think everybody in your discussion circles when somebody brings up the President's tweets or style. You should go in for the kill immediately and just say let's debate it. Let's talk about style because style is a tactic of getting to a goal and so we have to evaluate Joe Biden style versus Donald Trump style versus Barack Obama style versus George W. Bush's style. Let's look at what style works and I think Washington is been trapped in this status quo style bastion for so long. I love the question that even the other night President from God, which was why don't you act more Presidential that such a Washington definition of what a President needs because the rest of America doesn't really like the Washington styles. Let's debate it is a journey that they thought that Presidential thing out. I go back and think to myself will Jimmy Carter acted against Presidential with the Middle East.

Even with the campaign records ends up being a mess and we have hostages in Iran we can get out.

You know I can go through the list Presidential what does that even mean okay, but acting Presidential means. It means in the campaign as a candidate you promise to move the embassy to Jerusalem and then as President. You have to be like no I can't write that residential incentive. I promise that I did it. Go ahead with the control, but this is just that I was this how I talk to people. Ricky accuses because every time I'm out with the group and they know what I do and I'm sure this happens more even with you, but they say you know I just wish he wouldn't tweet this one tweet that I sent you. I always I line is always this. I'm just thankful I'm a prisoner I know were his mind.

It's like I know what he's thinking I know where where he wants to be. He's not hiding the block, hiding the buck and that is what most politicians on both sides of the aisle you cannot read even person. They will smile at you, they will shake your hand. You can come out there thinking you got a deal and they could do that all day to both sides of the issue to every body and no deal would come out and I think that's what people have gotten used to this kind of slick, shake your hand, you have no idea where they are. Don't ever tell you what's wrong or right. Don't ever say yes or no and so you kinda have to play a guessing game on where their policies actually to fall them or hire a lobbyist in order to understand what what the rose. Look, I've been around Washington long enough to know that there is this hall you know there's been this hopeless from the media for very long time to say we want to know more.

We want politicians to be transparent. We want to know what you're thinking before you issue a press release about the decision and that that's been the mantra for about 10 or 15 years and I think the reality is that reporters have that now in this President they see his thinking they see his process and now they're complaining about it though. To me it just goes to show that whatever Washington is asking for whatever this kind of bureaucratic politician, reporter Fields, no. All collectively what they want is really not what the American people, but it seems to me I was to be hospitalized. Time of the present. All three of us are talking, this is this is lays out the table. He lays it clearly every kind and lays a lot of things on Tivoli. Rick said he uses evenly to the tweets it's it's his thinking is that the final decision how he's processing through and if people are used to that there used to just this kind gift wrapped final packages with this election is there trying to run this off of when you rather have the old man who just reads the Teleprompter. That's what they're kind of think that there where here's the thing you got there used to rent you get a nice binder got that nice Presidential seal on it to open it up. Here's your position paper and then you say it instead we've got a guy we just sent it thinks it is. I don't like the light what's in the position paper. Go ahead, let's dig deep jet you're exactly right. That's what they want and and what that means, that little nice binder with with the seal on what that represents and what that means is the power of the bureaucracy that the Japanese secretary of this and that and the assistant secretary and the principal deputy assistant secretary gets to formulate everything into that binder and so what Pres. Trump is done and what he does in the Oval Office constantly take away the power of the bureaucracy to decide and he decides and he tries to say will now go do it in so I like it a lot actually II think that his thinking, although it completely upsets Washington and they're going to attack him for being whatever and Presidential means. He is so focused on what the American people want and and I just hope that our listeners really understand that when he's in the Oval Office with multimillionaire executives.

He's constantly pushing them to say you know how does this decision affects the bottom line for the Americans. He really is. Focus on that. I've seen it over and over and it's really refreshing and is it really is a piece up you will see this piece so I just got about a minute and 1/2 left with Rick at today and so this piece about what we want people to share with all tweeted out you'll retweet it as well.

It's on this so that because I think I think the important thing because we are talking artists are talking a lot of people Rick that are getting those questions and they they are probably sometimes maybe the PO where they got the question at work where they get the question a church where they get the question even in home from that, you know that there their loved ones and family is, how do I engage these discussions and it's gonna be you know an overload of those discussions. From now until election day, but I think just take friends and have a conversation with your family. You expect your family and you expect those that you love to be really honest with you, you don't always expect them to say everything that you're comfortable with.

But I would much rather have a close relationship with a family member or a politician that represents me being totally honest and transparent rather than package and really making it so that I don't know what they actually don't focus. Check out Rick's new piece. Pres. Trump's style is working a special visor for the ACLJail national security and foreign policy Rick Birthday. Thanks for joining us today.

Folks, we come back on the broadcasts or take your phone calls 164 3110. This election day extension that were seen by courts in election days now days longer if it's a vague pending on where you put your bow drop about the bar said for legal challenges to each ballot is is is again babysitting a call to testify under oath about their ballot to the people even exists. Try to find talk Mexican about Jay Sekulow live ACLJ on the frontlines protecting your freedom is defending your rights in court in Congress and in the public arena. The American Center for Law and Justice is on your side.

If you're already a member thinking. If you're not well this is the perfect time to stand with us, ACLJ.org, where you can learn more about our life-changing work, member today ACLJ live from Washington DC Jay Sekulow and secular Jay Sekulow like this Jordan secular. We are the people been holding on record to come on early in the broadcasts new piece about the tweeted out for you write the broadcast present Trump style is working. That's up. Remember he is ACLJ special visor financial security for policy. I don't like to it to advise on the air, but this is someone who just left present Trump's cabinet.

Who's coming to you because we commitment weeks ago still very close to the present. Obviously, you know, in his role, he does it on here. He doesn't really like cut into quarters like us doesn't say all Republicans are the perfect ones. Democrats are there are always wrong. It's really about 10 of how things have changed with this administration's not so like both this way vote that way it's more individual by individual but that so he's he's got those relationships still, but I think it's just it's so key that were bringing you that a couple times a week when you're all being inundated as if you're listening this broadcaster probably someone who does talk to your family and friends about politics. It isn't something to that you don't discuss something I should do discuss at the dinner table and you do discuss a church you do discuss maybe even at work with your colleagues at the appropriate times and they may have questions for you because you're one of the more informed people and they may say things. There are plenty of people I know who say they're going present tropic, but they'll say the thing like I did like this tweeter. I didn't like that tree they don't look at him like the big picture why they even are voting for him in the first place. That's what Rick's talking about is in this piece is how you talk to people about how you feel can and if you look at it from people who were due who dealt with and work with them every single day. Can you, can anyone argue we can you legitimately as Harry Huxley destroys a director can anyone really argue that whether you like his style or not, that this President has got an awful lot done including the reshaping of the Middle East, could you argue that in a straight face and like all his styles really hindered the American extreme of the American government, absolutely not. It is clear beyond question. This President has promised a lot, but he is also delivered and on policy. He has been rock solid and so one of the things that I think listeners have to think about is you should decide this election on the basis of the future of your children as opposed to what the blogosphere is saying about the latest tweet by the President and so I think for most rational observers, it is clear beyond question that President from based on his performance is entitled to reelection without a doubt that what about the bike and I understand the question to having Chris Rick bring up a good point in a week will get to the selection issue in a moment, but the key is the great disruptor in that sense present from an NDC doesn't like that all day.

I can tell you that.

I mean, that's part of the road writers and that there are some in Washington DC who will be against the presents. They don't like being disrupted look. I said this before J but I just think the American people are way ahead of Washington DC on this day. Had they do not like what they been getting out of the city for a long long time and they were desperate for disruption. Now look they may or may not think that this was the best way to disrupt it, but they were desperate to have it done and I honestly think they the only way to maybe maybe even compete with Pres. Trump on that is to promise a disruption. You can may be promising another way, but promising to go back to what we had before which is essentially with the Biden campaign is promising day.

I I just don't think that has a prayer of having traction with the American people. Dave decided that Washington DC is been doing it wrong for a long time. I think it was. We have covert we had to do top some tough economic times are thankfully not as tough. Honestly, as it could be a not speak very minor summary of our going to really tough times as wildfires, hurricanes or stings you got a deal with you know it. There haven't been we pet we destroyed Isis taken out their leadership has been the kind of terrorism, international terrorism that was seen at domestic level could say even that's very regional dependent on where you live and if Yorty know that you live in a liberal college town.

Well, your place like Portland you may be dealing with more protesters if you live in a red state in a in a red state capital and so that's kind like what you would assume things have been still booming and like to the recovery started before there was a vaccine for covert is not a vaccine today and the recovery Artie started economically think about that is because the business world finance world global trust is present, whether they like to say it or not they do with their pocketbooks stock challenges facing Americans or substantial time in our Valley freedom sword constitutional rights are under attack more important than ever to stay with the American Center for Law and Justice ACLJ on the frontlines protecting your freedoms and rights in courts in Congress and in the public arena and we have an exceptional track record of success.

But here's the bottom line we could not do her work without your support, we remain committed to protecting your religious and constitutional freedoms that remains our top priority, especially now during these challenging times. The American Center for Law and Justice is on your side, you're already a member. Thank you.

Well, this is the perfect time to stand with us ACLJ.where you can learn more about her life changing, member today ACLJ only one. A society can agree that the most vulnerable invoice.

Is there any hope for that culture to survive. And that's exactly what you are saying when you stand with the American Center for Law and Justice, defendant the right to life, we've created a free powerful publication offering a panoramic view of the ACLJ's battle for the unborn Gold edition will show you how you are personally publication includes a look at all major ACLJ were fighting for the rights of pro-life activist ramifications 40 years later, when Obama care means to discover the many ways your membership is empowering the right question for mission life today online/hold on the percent are the broadcasts and talk about what happened in Pennsylvania to on election lilies quickly recap it so Supreme Court and this is a quick recap we had the discussion with your calls and audit so mail-in ballots in Pennsylvania previously been due by the time polls close on election day, the courts, Supreme Court order has added consist recorded Pennsylvania as a Democrat party lawsuit. To do this added a three day extension to receive ballots as long as they're postmarked by 8 PM on election day ballots with a pre-election postmark will not be counted as long as they are received by 5 PM on November 6, three days after the polls close. This also includes in in this holding by this report.

If you can't read the postmark or there's no postmark at all. The presumption is it was in on time and that they set a legal standard for how to challenge every ballot that you so if you want to come in if you're the Republican Party or wait maybe or Joe Biden's campaign down 200,000 votes.

This is gonna make it harder for you but it tells me the Democrats don't think that about Pennsylvania right now but I don't think there could be the one.

Time to go to court challenging ballots. This is the thing I want to read because I read this in the first 30 minutes as I think is really important.

This is where the mischief comes in on election day, or the three days after the court also wrote that ballots and reporting from the court here received within this. Three.

That lack a postmark or other proof of mailing or for which the postmark or other proof of mailing is eligible eligible will be presumed to have been mailed by election day, unless a preponderance of the evidence demonstrates that it was mailed after election day, so no postmark. Nothing happens.

It's stuck in a mailbox but never gets posted in a never goes the Lord were sent to a place in its presumed to be valid and now the burden is on the challenger Andy just by preponderance of evidence that that's the problem that this is all made up. In other words, the Supreme Court of Pennsylvania has decided to make up a law and to say, why isn't it by you that if you receive it after word, and that the children eligible postmark that it is presumed to have been alive sent by the clock on the day of the election. If you can show that by the preponderance of the Evans lot where you get that from one to say by strict proof, one would you use the criminal standard beyond reasonable doubt. When we pick that went with it is made up law. But this ambiguity carry allows for the mischief absolutely Supreme Court has issued an open and obvious invitation for voter fraud to particularly the Democratic Party, which sued to get approval for this process. The court's decision exceeds its constitutional and legal authority because, quite simply, under the Constitution. The responsibility for determining the time, place and manner of elections lies solely within the purview of the legislative branch.

Even the Pennsylvania Supreme Court concedes this particular point, but then the court goes on to make up law law for which there is not us a legal basis for appendectomy making up law, it just happens in the Jordan law about an election for President states, Pennsylvania.

Like you said because is not only key state because the electoral votes but also is a East Coast date which can impact West Coast stateroom format inspect all absolutely this is state that again. It comes in later because it's large but I mean if it's trending Republican and those early exit polls show that what will exit polls rate if they have the million plus mail-in ballots that if they don't even have a postmark can be counted as good but will any of those things mean nothing now then I think they did what the Democrats are set up here is the best case there for the been in a lot of the states is keep keep it from being called for Donald Trump there.

That scared that he just starts the wave begins on the East Coast and in that wave starts and it is builds and builds and builds ignored hits and the hardest is not really Arizona by time you get to Arizona the way be the start of the not so it's Midwest states that Pennsylvania connects to via West Virginia. It's Ohio and then you can tell I get to its is places like Wisconsin and Minnesota. They start dropping because of Pennsylvania and then you let people turn off the TV. Donald Trump is been reelected President and by two in the morning or so on the East Coast. You can go to sleep knowing who your presence can be who can be sworn in as the next President states they don't want that's there.

They want the snare of the unit to be have to be up for days, weeks is Nancy Pelosi, you have to swear not present temporarily. I mean seriously that's what they want people that that's the mindset if they can cause the chaos that's a victory for them right now shows me how confident they are will always pull the children go by with a two point lead Joe by with a two point leader Joe Biden getting beaten each of those states by eight points. They know that they know that you look at the poles from 2016 at music Joe Biden loses almost every state in the country. Rates could literally went could lose 40 states now know polls ever going to show that in fact they can always oversample Democrats see the show bite bite with these small leads now Republicans have to show up to vote with. That's the one big question out Mark here, I think, and I will get your phone calls now one 800 684 30 went to the big question is how does covert affect actual voting because Republicans on election day show up. Democrats typically are harder to get out to vote on election and that's what he loved this mail and stuff. 20 love this affected you could drop it off at a male at some box and then you're done.

Your three weeks before the election, and not just on early voting and not tell you but absentees put generally on election day you if you're a Republican voter registered Republican shows up to vote. The present election in a democratic voter you can assume may not select the diff two different senses of everybody was registered Democrat voted Democrat showed up in these elections, we Republicans could not win a single election anywhere in the country. 9 Ancient Their Way out registered Democrats a lot people's of switch parties long ago but never change registration.

Some states can afford shoot you out.

You can fill in the primaries so depends on that, but I can only go to people's phone calls to light rain to behold non-aligned to ready welcome to Jay Sekulow life. You're on the air.

Thank you my call.

You probably already answered my question but that election day, the first Tuesday after the first Monday so shouldn't any vote after that be void. That's actually so that's actually a statute of Congress that actually sets. That is the first Monday of the first Tuesday after the first Monday so but, yes, but you go ahead and finish appointment. You would think that would make it very simple election days that they that's the day of election. The Constitution says ready is that Congress establishes a date that's election day, Congress done that through statute. It's the first Tuesday in November.

We all know that so everybody knows it's clear there has been discussion about should that be a day off in a lot of countries there is a day a day off and it's never really that would be caught you up to, Congress should be a federal holiday. At least that would be the every business will be close with should should, of course, the program has to do a lot of work on election day centers. They settled there is only raining when finger picked an ex parte question because this is the least interesting question. Go ahead, mail-in voting be constitutional. And because of all the hell ballots, and after elections only mailing valid could be constitutional because the state set up the process for balloting for casting the boat, but the legal issue is this is where does become a constitutional issue and that Pennsylvania Supreme Court decision may go to the US Supreme Court and that would be if Albert Harry first and Andy and then and that is if in fact that happens and there's challenges where this is appealed up it could violate the provisions of our Constitution, which sets up for due process balloting at least on Bush versus Gore absolutely and I think the caller raises a very very important point. In other words, does election day actually mean election day or can state courts arbitrarily without any legal or constitutional foundation extend election day and essentially what the Pennsylvania court has done is that they have given us an arbitrary, capricious and ideologically biased decision designed to tilt the election toward the Democrats and also Andy Creek. This is the grounds for Mr. this is how you create electoral district and that's the whole idea behind what the Democrats are doing folks, this is an attempt to create chaos and mischief so that they can steal the election and I'm one of said just outright.

Just like that.

Look, the law was enacted in 1845 and it was called the Presidential election day. Act not week act, not month ad and it says that the election day shall be the Tuesday next after the first Monday in the month of November. Now when you start extending these for three days because of mailing and things like this, you have violated what the statute says and you have not disenfranchise people you have violated the law, you go and vote on election day you vote the proper way in the proper fashion not through a made up his will you say well if it's postmarked on this day by a preponderance of the evidence you come up with that day to come up with a reason beyond reason want to use the criminal standard related folks, we are backward to ignore your phone calls to people and holding on sets were in your final save the broadcast 1-800-684-3110 to talk to us on air. That's what hundred 684-3110 Rick announced new pieces up on ACLJ that are present trump style is working. I will tweak that right after broadcast that to me that as well, him on Twitter and social media right back on Jay Sekulow live only one.

A society can agree that the most vulnerable invoice is, is there any hope for that culture to survive. Thank you for your thoughts. Well, this is the perfect time to stand with us. ACLJ.org where you can learn more about her life changing, member today ACLJ stitches and voting rights of phone calls were 100 684-3110 with Bruce in Colorado online six Bruce Walker Jay Sekulow live your on the air. Thanks for taking my call.

I will Colorado help about a half-dozen years now, mail-in balloting and so far they've been able to keep election day as election day like what we're hearing now, but I think it communication factor needs to come in play there in Colorado you hat they communicate over and over that if your ballot is not received by 7 PM on election day that they actually have that valid.

It will not be counted in that's different for each state is different that's the right way. That's how the states it already and let me let me just say this Bruce I think you probably agree with me. Your state has done as you said like you half a decade or more Presidential elections are not the election cycle used to try try things out to see if they work or not, because you get way more votes Bruce way more people show up, you way more ballots when whereabouts are filled out wrong we were. Ballots shouldn't be counted because they were done incorrectly or they'll shall protect it so you just don't use Presidential elections as the test elections use a midterm use local elections use primaries.

There's lots of ways you could do it over multiple cycles before you say were to do this on the election. We have once every four years to choose who is going to be the very powerful commander in chief and leader of the free world that that the election date you choose to start testing new styles of voting new ways of voting.

That's why it's great to Colorado to get it to handle that, but states that don't have that Artie set up can't figure out two months okay I really trust the Postal Service working with your state government, which in most of your states hasn't even showed up to work and since March and the like to redo redo voting northern alleges get voting down on election day.

I would just like to stay so focus on get enough people to work with covert everything so that everybody can get in there doesn't have to wait in line 10 hours like you to go vote and spin the resources there. So it's safe to go and make sure that you tell your citizens it's safe instead of scaring them all to death why Democrats are doing that out.

I'll be honest, I think Democrats telling who who who get a lot of votes from people in economically tougher areas and minority communities and they told them if you go outside you will die. So they're going to have to figure out another way to get their vote. Somehow even legally is another way to try to figure out another way to get their vote that were there fraud here because they've told people don't know if you live in a big city. Don't wait lighted out half of the people you will die. So why would you do it election day. Why would you show up for Joe Biden but that he had a guy you should open and risk your life for but that that's something that might've been for a lot of people and a lot of communities back because it was so historic what he was doing that I saw. I went to go, but I was in Norfolk at the time that I get paid more than what minority population.

A lot of people there were 60+ years old would never vote in the present election before pipe primarily African-American. We know African Americans one are more affected by covert.

We know that there is not to be vaccine on election day and its Democrat blue states that preach.

Don't go outside this not read states. That's a happy go to red states are very pretty pretty open little blue state.

It's a ghost town. Everywhere you go, so that if there try to figure out ways that had had we get there vote without telling Sundin that we know is okay but we don't really want to tell him it's okay because other part.

I think with any said earlier's right knee stretched as election Presidential election day and were now returning into election month election weeks or election quarter like this is this is that you know that I will tell you as a lawyer that's involved in some of this that the post election day litigation I suspect will be very significant out. I want to run quickly at the end of this in overtime on time your calls but then is there any sense what, our Congress even talking about this or is it like mom is the word here. Another all campaigning yet.

I think there's some concern, especially from officials in a state you heard Sen. Toomey and I think most of the concerned jays can revolve around the fact that the Pennsylvania legislature J they knew good and well when election day was and they wrote this law. With that in mind. So for the Supreme Court to come in and overturn. They're not just eviscerating the federal statute it says it's a day there also overriding the authority of the legislature. Who knew when that day was J they knew and that day was. They started with that day and they backed the deadlines up from then if you allow this kind of chaos day I tell you what taking control away from state legislatures. This would just be the beginning. I reread back to the phone Beverly in Utah on line 5 Beverly walking the Jay Sekulow live your on their personal reason and I like you to be year-to-year and I wanted to know you legally challenge? Where do it. I will tell you the CSO, the American Center for laundromat talkers and Presidents were here, but this is part of the ACLJ as these cases reach Princeton Pennsylvania spring court case were to go to the US Supreme Court. The ACLJ would file a friend of the court brief. Why, because election integrity is vital to our constitutional framework so there's a basis upon which constitutionally anti-we would engage yes absolutely. Because of the constitutional right then that is being in my view disenfranchised because this is a constitutional. This is a statutory provision enacted by Congress over hundred years ago and it says election day and it says that's what the mandate is and that's the supremacy clause.

It takes precedence over state law and the state law cannot override what the federal law is and it mandates Presidential election day and it says when it is. That's the day like I should talk about polite society. The appeal of the probably plight site is mostly listing right now.

Polite society doesn't like you.

You would never be accepted into polite society as a matter how polite you are or nicer person you are now your. His polite society that actually polite or nice it just means fake micro timeout with Rick. It means yeah I do that I check these four boxes so that you your weight either side. Check the four box and we all love each other and you can't really dislike someone with with political views.

Think about this week we say like if the other side gets elected the world to burn down in polite society.

Those same people can go to cocktail parties together in real life right if you actually believe that the work, the world will burn down because George W. Bush was elected and then this in the bushes and the carriage could be in the same room together without like even polite's right so polite society means fake.

They believe what they say that I present for up they want to be the same room with him because he tells them to their face, and he does hold grudges because he actually believes it.

If you don't believe it. You got your cocktails together.

If you do believe it. You really shouldn't be able to because the things they say about each other if they actually believed would not be able to blossom into friendships after their out of office. They would hate each other serious dispassion.

Rick talks about it hit Vargas out Rick without touch my new blog ACLJ.org. That's exclusive content for us at ACLJ by the way, that when Rick is writing a special visor just for you. And he talks but how they hate present trip in Washington DC because he's not part of their group. Just go all play nice together or hire a lobbyist to handle it for you and that's that's the new way you really want to go back to the old way to give this up. That's the question this election. And while these laws are being changed.

Try to steal with that choice from ACLJ on the frontlines protecting your freedom is defending your rights in court in Congress and in the public arena. The American Center for Law and Justice is on your side. If you're already a member. If you're not well this is the perfect time to stand with us ACLJ.org where you can learn more about our life-changing work, member today ACLJ
